<br />RESOLUTION NO.4? <br />SERIES 1996 <br /> <br />A RESOLUTION CONCERNING TWO PETITIONS FOR THE ANNEXATION <br />OF PROPERTY TO THE CITY OF LOUISVILLE, COLORADO, KNOWN AS <br />THE SOUTHEAST LOUISVILLE ANNEXATION _ SOUTH 96TH STREET <br />& DILLON ROAD NO.1, AND THE SOUTHEAST LOUISVILLE <br />ANNEXATION - SOUTH 96TH STREET & DILLON ROAD NO.2, AND <br />FINDING THE AREAS PROPOSED TO BE ANNEXED ELIGIBLE FOR <br />ANNEXATION. <br /> <br />WHEREAS, two petitions for annexation of property described in <br />Exhibit A attached hereto, to be known as the Southeast Louisville <br />Annexation South 96th Street & Dillon Road No. I, and the <br />Southeast Louisville Annexation - South 96th Street & Dillon Road <br />No.2, have been filed with the City Council of the City of <br />Louisville by the Boulder County Board of County Commissioners; and <br /> <br />WHEREAS, pursuant to state law, the City Council held a <br />hearing and desires to adopt by Resolution its findings in regard <br />to the petitions and eligibility for annexation. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. The City Council finds and concludes that: <br /> <br />1. It is desirable and necessary that the territory <br />described in Exhibit A attached hereto and incorporated <br />herein be annexed to the City of Louisville. <br /> <br />2. The requirements of Sections 31-12-104 and 31-12-105, <br />C.R.S., as amended, exist or have been met, including: <br /> <br />a. Not less than one-sixth of the perimeter of the <br />areas proposed to be annexed are contiguous with <br />the City of Louisville; in accordance with C.R.S. <br />31-12-104 (1) (a), contiguity may be established by <br />the annexation of the two parcels described in <br />Exhibit A in a series. <br /> <br />b. A community of interest exists between the areas <br />proposed to be annexed and the City of Louisville. <br /> <br />1 <br />
