The applicant is now seeking to build a 429 square foot detached garage on the rear <br />(south) of the property, with access off of Jefferson Avenue to the east. In order to have a <br />properly sized two -car garage meeting the City's requirement for two off-street parking <br />spaces, and to meet the required rear setback for a garage of three feet, the garage must <br />be closer than 10 feet to the house. As originally platted, there was a 10 foot alley <br />running east -west on the south side of 633 Jefferson, providing alley access. That alley <br />was vacated by the City in two phases: first, the western portion behind 624 Pine in 1991, <br />and then the eastern portion behind 633 Jefferson in January, 2012. This added five feet <br />to the back of the property at 633 Jefferson, while eliminating the possibility of alley access <br />for the lot. <br />The City is currently in the process of amending the Louisville Municipal Code (LMC) to <br />reduce the minimum building separation requirement from 10 feet to five feet. A resolution <br />recommending approval of the change was adopted unanimously by Planning Commission <br />on April 12, 2012. First reading of the ordinance is scheduled for the May 15 City Council <br />session and second reading is anticipated on June 5. The ordinance would then go into <br />effect on July 5, 2012 if passed on second reading and not challenged in the intervening <br />30 days. Therefore, the variance being sought here would be allowed as a use by right in <br />the near future, if City Council approves the proposed ordinance. The applicant is seeking <br />this variance to allow construction to begin before the proposed code change has taken <br />effect. <br />7 <br />
