RESOLUTION NO.40 SERIES 1996 A RESOLUTION ACCEPTING THE DEDICATION OF AND QUIT CLAIM DEED TO CERTAIN STREET RIGHT-OF-WAY AS DESIGNATED AND DESCRIBED ON THE RECORDED PLAT OF BELLA VISTA SOUTH, A SUBDIVISION OF THE CITY OF LOUISVILLE, BOULDER COUNTY, STATE OF COLORADO. WHEREAS, the plat of Bella Vista South, a subdivision of the Ci ty of Louisville, Boulder County, Colorado, was approved and acknowledged on behalf of the City on February 19, 1980 by Resolution No. II, Series 1980i and WHEREAS, said plat is recorded In the office of the Boulder County Clerk and Recorderi and WHEREAS, the streets, alleys and easements designated and appearing on the plat are dedicated by statutory dedication to the City for the public use thereof foreveri and WHEREAS, a tract of land designated as Outlot "X" is designated on the plat to be dedicated street right-of-waYi and WHEREAS, Outlot "X" lies within the intersecting portion of the streets of Bella Vista Drive and Roosevelt Avenuei and WHEREAS, Outlot "X", despite not having been paved, has been used by the public as a traveled portion of street right-of-way for facilitating and improving turning movements at the intersection of Bella Vista Drive and Roosevelt Avenue; and WHEREAS, the City's anticipates that Outlot traffic safety at the Roosevelt Avenuei and traffic and street planning for the area "X" will be improved in the interest of intersection of Bella Vista Drive and WHEREAS, the owner of Outlot "X" has tendered a Quit Claim Deed to the City conveying Outlot "X" to the CitYi and WHEREAS, the City deems it health, safety and welfare of the acceptance of the quit claim deed in the best interests of the community to formally state its and the dedication of the above 1
