<br />WHEREAS, the City wishes to acquire the water rights <br />associated with both parcels of the Admor Property; and <br /> <br />WHEREAS, Louisville has no intent to acquire, use or hold the <br />West Parcel for any park, recreation, open space or any other <br />governmental purpose within the meaning of C.R.S. ~31-15-713(1) (a); <br />the West Parcel is being acquired in order to permit the City to <br />acquire an undivided one-half interest from the County in the East <br />Parcel, to obtain a conservation easement in the East Parcel to <br />preserve its character as open space, to annex the West Parcel to <br />the City, and to acquire the water rights associated with both <br />parcels; and <br /> <br />WHEREAS, pursuant to Section 38-30.5-101, et. se~., C.R.S., <br />the City and the County desire to grant reciprocal conservation <br />easements in the East Parcel in which each party agrees with the <br />other to terms and conditions governing the use and development of <br />the East Parcel for the purposes of preserving and protecting for <br />scenic, open space, agricultural, passive recreational and <br />environmental use, the natural condition and aesthetic and <br />ecological features of the Property. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />1. The Purchase Agreement between the City of Louisville and <br />Boulder County regarding the Admor Property is hereby approved in <br />essentially the same form as the copy of such Purchase Agreement <br />accompanying this Resolution and the Mayor is authorized to execute <br />the Purchase Agreement, except that the Mayor is hereby granted the <br />authority to approve such revisions to said Purchase Agreement as <br />the Mayor determines are necessary or desirable for the protection <br />of the City, so long as the essential terms and conditions of the <br />Purchase Agreement are not altered. <br /> <br />2. The Conservation Easements in Gross in the form attached <br />to the Purchase Agreement as Exhibit F are hereby approved. Upon <br />the closing of the Property purchase, the Mayor is authorized to <br />execute said Conservation Easements on behalf of the City. <br /> <br />PASSED AND ADOPTED this <br /> <br />1m <br /> <br />day of <br /> <br /> <br />, 1996. <br /> <br />2 <br />
