Sisk opened the public heating on
Ordinance No. 1353, Series 2000 and asked that discussion be continued to January 16,
2001.

MOTION: Sisk moved that Council continue second reading of Ordinance No. 1353,
Series 2000, to January 16, 2001, seconded by Brown. All in favor. Absent: Davidson -
excused.

ORDINANCE NO. 1354, SERIES 2000 - AN ORDINANCE DISCONNECTING
FROM THE CITY OF LOUISVILLE, COLORADO, A CERTAIN PARCEL OF
PROPERTY LOCATED ADJACENT TO SOUTH BOULDER ROAD IN THE
SW1/4 OF THE SE1/4, SECTION 4, TOWNSHIP 1 NORTH, RANGE 69 WEST
OF THE 6TM P.M. - 2nd reading - (advertised Daily Camera 12/10/00)

Mayor Pro-Tem Sisk recused himself from this matter due to a conflict of interest. He
asked Councilman Howard to conduct the proceedings on Item 7E.

Howard called for Staff presentation.

Public Works Director Tom Phare reported that in 1978 a property known as the Eicher
property, located on the north side of South Boulder Road and east of the Pow Wow
Grounds, was annexed to the City of Louisville. In 1983 the property owner requested
and was granted a de-annexation of their 10 acres. The property was subsequently
annexed to the City of Lafayette and is currently in the process of being developed as the
Westgate Office Park, Filing One. In reviewing some issues associated with the parcel, it
was found that the 1983 de-annexation omitted a 25-foot wide parcel along Louisville's
east city limits. At this time, the current property owner is requesting de-annexation of
the 25 feet to fulfill what is believed to be the intent of the first de-annexation. A review
of the parcel in the field did not identify any activity, city owned utilities or uses
pertaining to the City of Louisville. Phare noted that Staff has treated the de-annexation
request as a housekeeping matter, as there is no purpose to maintaining the parcel within
the Louisville City limits.

Councilman Howard opened the public hearing and asked if anyone in the audience
wished to speak for or against Ordinance No. 1354, Series 2000. Hearing none, Howard
closed the public hearing.
