<br />RESOLUTION NO. 19 <br />SERIES 1996 <br /> <br />A RESOLUTION ALLOWING THE LOUISVILLE CITY COUNCIL TO <br />WAIVE OR DEFER CERTAIN ANNEXATION REQUIREMENTS WHICH ARE <br />NOT REQUIRED BY STATE LAW. <br /> <br />WHEREAS, various resolutions and other actions of the City of <br />Louisville impose certain requirements on annexations which are not <br />required by state law and which are particularly appropriate where <br />development on the annexed land is proposed to occur soon after <br />annexation; and <br /> <br />WHEREAS, there may be proposed annexations of land on which <br />development of the land is not intended to occur soon after <br />annexation and for which development requirements are more <br />logically imposed at the time of development rather than at the <br />time of annexation; and <br /> <br />WHEREAS, it would be beneficial for the City to have the <br />flexibility to consider under different standards, annexations of <br />land on which development is not proposed soon after annexation. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />1. The City Council may, in its sole discretion, enter into <br />an agreement prior to annexation with the owner(s) of land to be <br />annexed to the City that, if the owner(s) agree not to propose <br />significant development of the land for a period of time acceptable <br />to the City Council, the City will do one or more or all of the <br />following: <br /> <br />(a) Waive all or certain annexation application fees, initial <br />zoning fees, and any other fees related to annexation of the land. <br /> <br />(b) Waive or defer to a later date, all or certain of the <br />requirements of City of Louisville Resolution No. 52, Series 1988, <br />A RESOLUTION REVISING CITY POLICY WITH RESPECT TO THE DEDICATION OF <br />WATER RIGHTS TO THE CITY IN CONNECTION WITH ANNEXATIONS, as amended <br />by Resolution No.9, Series 1989, A RESOLUTION AMENDING RESOLUTION <br />NO. 52, SERIES 1988, WITH RESPECT TO THE DEDICATION OF WATER RIGHTS <br />TO THE CITY IN CONNECTION WITH ANNEXATIONS, or as amended by other <br />resolutions of the City. <br /> <br />(c) Waive or defer to a later date, all or certain of the <br />requirements of City of Louisville Resolution No. 36, Series 1992, <br />A RESOLUTION ESTABLISHING THE POLICY FOR PROVIDING ADEQUATE PARKS, <br />TRAILS AND OPEN SPACE IN THE CITY OF LOUISVILLE, COLORADO. <br /> <br />1 <br />
