RESOLUTION NO. 25 SERIES 2012 A RESOLUTION DENYING A PRELIMINARY PLAT, PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD), AND SPECIAL REVIEW USE (SRU) APPLICATION TO CONSTRUCT FIVE (5) BUILDINGS WHICH WOULD CONTAIN A TOTAL OF 160 APARTMENT UNITS AND STRUCTURED PARKING, AND 9,500 SQUARE FEET OF RETAIL DEVELOPMENT ON TRACT ONE OF THE LOUISVILLE NORTH, FILING 7 SUBDIVISION LOCATED AT 707 EAST SOUTH BOULDER ROAD WHEREAS, there has been submitted to the Louisville City Council an application for approval of a preliminary plat, preliminary planned unit development (PUD), and special review use (SRU) to construct five (5) buildings which would contain a total of 160 apartment units and structured parking, and 9,500 square feet of retail development, on Tract One of the Louisville North, Filing 7 subdivision located at 707 East South Boulder Road; and WHEREAS, the City Council held a properly noticed public hearing on May 1, 2012, continued to May 15, 2012 and June 5, 2012, where evidence and testimony were entered into the record, including without limitation the application and supporting materials, the Louisville City Council Communications dated May 1, 2012, May 15, 2012, and June 5, 2012 and all attachments included with such Communications; referral agency comments; written public comments; the City comprehensive plan; the City subdivision and zoning ordinances set forth in titles 16 and 17 of the Louisville Municipal Code; and additional written statements and other documents, as well as testimony from the staff, applicant, City of Louisville residents and other witnesses; and WHEREAS, the City Council by this Resolution desires to set forth its findings, conclusions and ruling with respect to the application. • NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE,COLORADO: Section 1. The foregoing recitals are incorporated herein. Section 2. Based on the testimony of the witnesses and the documents and other evidence made a part of the record of the hearing before the City Council, the City Council finds as follows: a. The application is for a preliminary plat, preliminary planned unit development (PUD), and special review use (SRU) to construct five (5) buildings which would contain a total of 160 apartment units and structured parking, and 9,500 square feet of retail development, on Tract One of the Louisville North, Filing 7 subdivision located at 707 East South Boulder Road. The property is owned by Safeway Stores 45, Inc. The applicant is Loftus Development, Inc. (Loftus). b. The property that is the subject of the application is zoned Commercial Community (C-C).
