RESOLUTION NO. 25 <br /> SERIES 2012 <br /> A RESOLUTION DENYING A PRELIMINARY PLAT, PRELIMINARY PLANNED <br /> UNIT DEVELOPMENT (PUD), AND SPECIAL REVIEW USE (SRU) APPLICATION <br /> TO CONSTRUCT FIVE (5) BUILDINGS WHICH WOULD CONTAIN A TOTAL OF <br /> 160 APARTMENT UNITS AND STRUCTURED PARKING, AND 9,500 SQUARE FEET <br /> OF RETAIL DEVELOPMENT ON TRACT ONE OF THE LOUISVILLE NORTH, <br /> FILING 7 SUBDIVISION LOCATED AT 707 EAST SOUTH BOULDER ROAD <br /> WHEREAS, there has been submitted to the Louisville City Council an application for <br /> approval of a preliminary plat, preliminary planned unit development (PUD), and special review <br /> use (SRU) to construct five (5) buildings which would contain a total of 160 apartment units and <br /> structured parking, and 9,500 square feet of retail development, on Tract One of the Louisville <br /> North, Filing 7 subdivision located at 707 East South Boulder Road; and <br /> WHEREAS, the City Council held a properly noticed public hearing on May 1, 2012, <br /> continued to May 15, 2012 and June 5, 2012, where evidence and testimony were entered into <br /> the record, including without limitation the application and supporting materials, the Louisville <br /> City Council Communications dated May 1, 2012, May 15, 2012, and June 5, 2012 and all <br /> attachments included with such Communications; referral agency comments; written public <br /> comments; the City comprehensive plan; the City subdivision and zoning ordinances set forth in <br /> titles 16 and 17 of the Louisville Municipal Code; and additional written statements and other <br /> documents, as well as testimony from the staff, applicant, City of Louisville residents and other <br /> witnesses; and <br /> WHEREAS, the City Council by this Resolution desires to set forth its findings, <br /> conclusions and ruling with respect to the application. <br /> • <br /> NOW,THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF LOUISVILLE,COLORADO: <br /> Section 1. The foregoing recitals are incorporated herein. <br /> Section 2. Based on the testimony of the witnesses and the documents and other <br /> evidence made a part of the record of the hearing before the City Council, the City Council finds <br /> as follows: <br /> a. The application is for a preliminary plat, preliminary planned unit development <br /> (PUD), and special review use (SRU) to construct five (5) buildings which would contain a total <br /> of 160 apartment units and structured parking, and 9,500 square feet of retail development, on <br /> Tract One of the Louisville North, Filing 7 subdivision located at 707 East South Boulder Road. <br /> The property is owned by Safeway Stores 45, Inc. The applicant is Loftus Development, Inc. <br /> (Loftus). <br /> b. The property that is the subject of the application is zoned Commercial Community <br /> (C-C).
