b. The proposed SRU does not meet special review use criteria A.2 of Section <br /> 17.40.100 of the LMC. In particular, the applicant has failed to demonstrate that "such <br /> use/development will lend economic stability, compatible with the character of any surrounding <br /> established areas." In this regard, City Council concludes: <br /> 1. The height and density of the proposal would not be compatible with the nearby <br /> single-family residential neighborhoods. Both the height and density of the <br /> proposed development exceed standards applicable to multi-family <br /> developments in the C-C zone district as set forth in the LMC and are <br /> incompatible with the heights and densities within the surrounding established <br /> areas immediately to the south and east and the residential neighborhoods to the <br /> north. <br /> 2. The proposed development includes structures whose scale and mass is <br /> incompatible with that found in the surrounding established areas. Numerous <br /> neighbors testified that the development would introduce structures of imposing <br /> mass in locations and of character which are not in keeping with the <br /> neighborhood. <br /> c. The proposed PUD does not meet criteria B.I 5 of Section 17.28.120 of the LMC. In <br /> particular, the City Council concludes that the proposed PUD is not compatible with surrounding <br /> designs and neighborhoods. The height and density of the project does not reflect that found in the <br /> single and multi-family neighborhoods surrounding the proposed PUD, and requested variances for <br /> height and density do not meet the criteria for variances in Section 17.28.110. Further, the massing <br /> and placement of the proposed buildings do not promote harmonious transitions to areas of other <br /> uses, particularly with regard to transitions to existing residential neighborhoods. <br /> d. In addition to the foregoing, the City Council further concludes that upon denial of <br /> the SRU, the proposed preliminary plat and preliminary PUD become moot and should also be <br /> denied. <br /> Section 4. In accordance with the above findings and conclusions, and based upon the <br /> evidence and testimony presented at the hearing, the City Council of the City of Louisville hereby <br /> denies the application for approval of a preliminary planned unit development (PUD) and special <br /> review use (SRU) to construct five (5) buildings which would contain a total of 160 apartment <br /> units and structured parking, and 9,500 square feet of retail development, on tract one of the <br /> Louisville North, Filing 7 subdivision located at 707 E South Boulder Road, and based on the <br /> foregoing denial of the SRU, the preliminary plat and PUD are denied as moot. <br /> PASSED AND ADOPTED this JO- day of 4(,Unt , 2012. <br /> IAAAP- <br /> Robert P.
