RESOLUTION NO. 39 SERIES 2012 A RESOLUTION CALLING A SPECIAL ELECTION FOR NOVEMBER 6,2012, TO BE CONDUCTED AS A COORDINATED ELECTION, FOR THE PURPOSES OF ELECTING A WARD ONE COUNCILMEMBER AND SUBMITTING A TABOR BALLOT ISSUE TO THE REGISTERED ELECTORS OF THE CITY WHEREAS, pursuant to Section 3-6 of the Home Rule Charter, the City Council previously appointed a person to fill a Ward One Councilmember vacancy, to hold office until a special election to fill the vacancy, which election is required to be held on the same date as the statewide general election if such an election will occur before the next regular election; and WHEREAS, a statewide general election will occur on November 6, 2012, before the next regular election; and WHEREAS, the City Council further finds it in the best interests of the City of Louisville to call a special election for November 6, 2012 for the purpose of referring to the registered electors of the City a TABOR ballot issue concerning continuation of the City sales tax for open space acquisition, development, maintenance and related purposes; and WHEREAS, pursuant to Section 6-3 of the Home Rule Charter, the City Council may call a special election by resolution adopted not less than 60 days prior to the date of the election; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. A special election is hereby called to be held on Tuesday, November 6, 2012 as part of a coordinated election. Section 2. The purpose of the special election will be a candidate election for election of a Ward One Councilmember and to submit to the registered electors of the City a TABOR ballot issue concerning continuation of the City sales tax for open space acquisition, development, maintenance and related purposes. The City Council may submit such TABOR ballot issue to appear on the ballot of the special municipal election by the adoption of appropriate resolution or ordinance as required by law. Section 3. The officers and employees of the City are hereby authorized and directed to take all necessary and appropriate actions to effectuate the provision of this Resolution in accordance with Colorado law. Section 4. Pursuant to C.R.S. Section 31-10-102.7, the City will utilize the requirements and procedures of the Uniform Election Code of 1992, articles 1 to 13 of title 1, C.R.S., as amended, in lieu of the Colorado Municipal Election Code of 1965, article 10 of title 31, C.R.S., as amended, with respect to the special municipal election to be held on November 6, 2012, and such election shall be conducted as part of the coordinated regular election.
