<br />
<br />AN ORDINANCE VACATING A ROAD RIGHT-OF-WAY BEING TWENTY
<br />FEET OFF THE EAST END OF LOT 1, LOT 6, LOT 7 LOT 8, LOT
<br />9, LOT 10, AND LOT 11, JEFFERSON PLACE SUBDIVISION.
<br />
<br />WHEREAS, certain property currently located within the City, II
<br />being twenty feet off the east end of Lot 6, Lot 7, Lot 8, Lot 9,
<br />Lot 10 and Lot 11, and twenty feet off the east end of Lot 1, Block
<br />1, Jefferson Place, was transferred to Boulder County for road
<br />purposes as set forth in a certain deed dated the 16th of May,
<br />1889, recorded with the Clerk and Recorder's office of Boulder
<br />County on June 10, 1889, in Book 122, Page 419; and
<br />
<br />WHEREAS, the described property is not and has not been used
<br />or required as a thoroughfare for the public or for any public use;
<br />and
<br />
<br />WHEREAS, Boulder County conveyed to the City that portion of
<br />the described property being the twenty feet off the east end of
<br />Lot 1, Block 1, by deed dated the 29th of August, 1995, recorded
<br />with the Clerk and Recorder's office of Boulder County on September
<br />22, 1995, on Film 2078, Reception No. 1549721, and the City has
<br />acquired ownership of the remaining portion of Lot 1, Block 1,
<br />Jefferson Place; and
<br />
<br />WHEREAS, Boulder County conveyed to the City the remaining
<br />portion of the described property being twenty feet off the east
<br />end of Lot 6, Lot 7, Lot 8, Lot 9, Lot 10, and Lot 11, Block 1,
<br />Jefferson Place, by deed dated October 31, 1995; and
<br />
<br />WHEREAS, the City Council desires to vacate the described road
<br />right-of-way and has determined that such a vacation is in the best
<br />interests of the City and the public.
<br />
<br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
<br />OF LOUISVILLE, COLORADO:
<br />
<br />Section 1. That portion of the following described road
<br />right-of-way situate the Jefferson Place, City of Louisville,
<br />County of Boulder, State of Colorado is vacated and the title
<br />thereto shall vest as provided by law:
<br />
<br />Twenty feet off the east end of Lot Six (6), Lot Seven
<br />(7), Lot Eight (8), Lot Nine (9), Lot Ten (10) and Lot
<br />Eleven (11), also twenty feet off the east end of Lot One
<br />(1), in Block One (1) in Jefferson Place.
<br />
<br />Section 2. All existing easements for public utilities, if
<br />any, shall not be altered or amended by virtue of this ordinance.
