WHEREAS, certain portions of Harper street and Lincoln Avenue within the Fisher Subdivision, City of Louisville, County of Boulder, State of Colorado recorded in the office of the Boulder County Clerk and Recorder at Plat Book 5, Page 43, are not used or required as thoroughfares for the public or for any public use; and WHEREAS, the portions of Harper Street, Lincoln Avenue and a 7.5 foot strip of land to be vacated herein are located within a parcel of property which the City conveyed during 1985 to George R. Mattern and Caroline A. Rickus by deed recorded at the office of the Boulder County Clerk and Recorder, Reception No. 701394, Film 1363; and WHEREAS, at the time of the conveyance during 1985 the City inadvertently failed to vacate those portions of Harper Street, Lincoln Avenue and the strip of land located within the parcel and now desires to do the same; and WHEREAS, the City Council declares an emergency as it is necessary to timely vacate the streets in order to provide clear title to the property previously conveyed by the City; and WHEREAS, the vacation is in the best interests of the City and the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. That portion of Harper Street described below is vacated and the title thereto shall vest as provided by law. A parcel of land being a part of Harper Street, FISHER SUBDIVISION, City of Louisville, County of Boulder, State of Colorado, as shown of the plat recorded in the office of the Boulder County Clerk and Recorder at Plat Book 5, Page 43, and being more particularly described as follows: 1
