<br />WHEREAS, none of the amendments herein conflict with state <br />purposes, and it is the declared intent of the City not to conflict <br />with the Oil and Gas Conservation Act or any regulations of the Oil <br />and Gas Conservation Commission. These amendments reenforce the <br />provisions of the Act and Regulations and do not conflict with any <br />provisions therein. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Amend Section 8.24.010 of the Louisville <br />Municipal Code is hereby amended to read as follows (words to be <br />deleted are stricken through; words to be added appear in capital <br />letters) : <br /> <br />8.24.010 Prohibited. <br /> <br />It is unlawful for any person, company or <br />corporation to mine, or cause to mine for any coal or <br />other mineral or gravel, or a combination thereof, within <br />the city limits of the city. It is also unlawful for any <br />person, company or corporation to drill or cause to drill <br />for oil or gas, or a combination thereof, within the city <br />limits of the city unless said person, company, or <br />corporation shall have been specifically approved for a <br />special review use under Section 17.16.250 CHAPTER 17.68 <br />of this code and unless all other applicable ordinances <br />of the city are met. <br /> <br />Section 2. Section 17.16.250 of the Louisville Municipal <br />Code is hereby repealed in its entirety and reenacted, with <br />amendments, to read as follows: <br /> <br />17.16.250 Oil and gas exploration and production. <br /> <br />Oil and gas exploration and production may be <br />permitted in any zone district as a use permitted by <br />special review according to and in compliance with the <br />requirements of Chapter 17.68, but only if all <br />requirements of Chapter 17.68 are met. The notice and <br />hearing procedures applicable to special review uses set <br />out in Chapter 17.40 shall apply to applications for <br />special review under Chapter 17.68. <br /> <br />Section 3. Chapter 17.68 of the Louisville Municipal Code <br />is hereby repealed in its entirety and reenacted, with amendments, <br />to read as follows: <br /> <br />3 <br />
