<br />ORDINANCE NO. 1191 <br />SERIES 1995 <br /> <br />AN ORDINANCE AMENDING SECTION 17.56.070 OF THE LOUISVILLE <br />MUNICIPAL CODE CONCERNING THE OFFICIAL FLOODPLAIN MAP AND <br />DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the Federal Emergency Management Agency has or will <br />adopt an updated flood insurance study and rate map applicable to <br />the City of Louisville; and <br /> <br />WHEREAS, the City Council has determined that is necessary to <br />the immediate protection of the health and safety of the citizens <br />to adopt such update so that the location and boundaries of the <br />flood regulatory district within the City are properly designated <br />and identified. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Section 17.56.070 of the Louisville Municipal <br />Code as adopted in Ordinance No. 1188, Series 1995, is amended to <br />read as follows (words to be deleted are stricken through; words to <br />be added appear in capital letters): <br /> <br />17.56.070 "Establishment of official maps." <br /> <br />The location and boundaries of areas within the <br />flood regulatory district are identified by the Federal <br />Emergency Management Agency in a scientific and <br />engineering report entitled, "The Flood Insurance study <br />for Louisville," dated January 1, 1973 JUNE 2, 1995, with <br />an accompanying flood insurance rate map (FIRM) as <br />adopted and amended from time to time, which is hereby <br />adopted by reference and declared to be a part of this <br />chapter. Copies of the official map are kept on file <br />with the city engineer, the planning department and the <br />city clerk. The boundary lines on the map shall be <br />determined by the use of the scale appearing on the map. <br />Where there is a conflict between the boundary lines <br />illustrated on the map and actual field conditions, the <br />dispute shall be settled according to section 17.56.190. <br /> <br />Section 2. If any portion of this ordinance is held to be <br />invalid for any reason, such decision shall not affect the validity <br />of the remaining portions of this ordinance.
