<br />ORDINANCE NO. 1189 <br />SERIES 1995 <br /> <br />AN ORDINANCE AMENDING SECTION 1.28.020 OF THE LOUISVILLE <br />MUNICIPAL CODE CONCERNING THE SERVICE OF MUNICIPAL COURT <br />SUMMONS OR SUMMONS AND COMPLAINT <br /> <br />WHEREAS, Section 1.28.020 of the Louisville Municipal Code is <br />in need of revision so that it conforms to the Colorado Municipal <br />Court Rules of Procedure. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Section 1.28.020 of the Louisville Municipal <br />Code is hereby amended to read as follows (words to be deleted are <br />stricken through; words to be added are capitalized): <br /> <br />1.28.020 Service of summons and complaint. <br /> <br />A summons OR SUMMONS and complaint issued pursuant <br />to a violation of this code shall be served IN ACCORDANCE <br />WITH THE PROVISIONS OF RULE 204 OF THE COLORADO MUNICIPAL <br />COURT RULES OF PROCEDURE, AS AMENDED FROM TIME TO TIME <br />personalll upon the defendant and a cOPl gi~en to him. <br />In lieu of personal sendee, service mal be made bl <br />lea~ing a copy of the summons or scrmmons and complaint at <br />defendant's usual place of abode with some person o~er <br />the age of eighteen lears residing therein. <br /> <br />Section 2. The repeal or modification of any provision of the <br />Municipal Code of the City of Louisville by this ordinance shall <br />not release, extinguish, alter, modify, or change in whole or in <br />part any penalty, forfeiture, or liability, either civil or <br />criminal, which shall have been incurred under such provision, and <br />each provision shall be treated and held as still remaining in <br />force for the purpose of sustaining any and all proper actions, <br />suits, proceedings, and prosecutions for the enforcement of the <br />penalty, forfeiture, or liability, as well as for the purpose of <br />sustaining any judgement, decree, or order which can or may be <br />rendered, entered, or made in such actions, suits, proceedings, or <br />prosecutions. <br /> <br />Section 3. All other ordinances or portions thereof <br />inconsistent or conflicting with this ordinance or any portion <br />hereof are hereby repealed to the extent of such inconsistency or <br />conflict. <br /> <br />Section 4. This ordinance is deemed necessary for the <br />protection of the health, welfare and safety of the community. <br /> <br />1 <br />
