<br />35. "Substantial improvement" means any reconstruction, <br />rehabilitation, addition to or other improvement of a structure, the <br />cost of which equals or exceeds 50 percent of the market value <br />of the structure before the "start of construction" of the <br />improvement. This term includes structures which have incurred <br />"substantial damage," regardless of the actual repair work <br />performed. The term does not, however, include either: <br /> <br />a. any project for improvement of a structure to correct <br />existing violations of state or local health, sanitary, or <br />safety code specifications which have been identified by <br />the local code enforcement official and which are the <br />minimum necessary to accessibility and assure safe living <br />conditions; or <br /> <br />b. Any alteration of a "historic structure," provided that the <br />alteration will not preclude the structure's continued <br />designation as a "historic structure." <br /> <br />36. "Watercourse" means a channel, natural depression, slough, <br />artificial channel, gulch, arroyo, stream, creek, pond, reservoir, or <br />lake in which storm runoff and floodwater flows either regularly <br />or infrequently. This includes major drainageways for carrying <br />urban storm runoff. <br /> <br />17.56.020 Statutory authorization. <br /> <br />The ordinance codified in this chapter for flood prevention and <br />control is adopted pursuant to the authority contained in section 31-23- <br />301, Colorado Revised Statutes of 1973, as amended. <br /> <br />17.56.030 Findings. <br /> <br />The city council finds that there are within the city floodplains <br />which constitute natural hazards of state and local interest, that flooding <br />may cause serious damage to properties and subject residents of such <br />areas to hazards, that the occupation of such areas may cause the loss <br />of human life and the destruction of property, and that the imprudent <br />use and occupation of these areas will pose a continuing and greater <br />future danger to life and property unless appropriate regulations are <br />adopted concerning the use and occupation of such hazards. <br /> <br />7 <br />
