<br />ORDINANCE NO. 1181 <br />SERIES 1995 <br /> <br />AN ORDINANCE AMENDING THE DEFINITION OF "PERSONAL SERVICE <br />SHOP" IN SECTION 17.08.370 OF THE LOUISVILLE MUNICIPAL <br />CODE TO INCLUDE MASSAGE THERAPY FACILITIES <br /> <br />WHEREAS, the Zoning Ordinance of the City, codified in <br />Chapters 17.04 through 17.52 of the Louisville Municipal Code, does <br />not contain a use group category that includes facilities for <br />massage therapy; and <br /> <br />WHEREAS, the personal services and facilities operated by <br />licensed massage therapists are similar to "personal service shops" <br />as defined in the Zoning Ordinance of the City; and <br /> <br />WHEREAS, the City Council finds that the Zoning Ordinance <br />should be amended to include facilities for massage therapy under <br />the definition of "personal service shop"; and <br /> <br />WHEREAS, the City Council has determined that the proposed <br />amendment is necessary for the protection of the health, safety and <br />welfare of the community. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Title 17, Chapter 17.08 of the Louisville <br />Municipal Code is amended to read as follows (words to be deleted <br />are stricken through; words to be added appear in capital letters); <br /> <br />17.08.370. <br /> <br />Personal Service Shop. <br /> <br />"Personal service shop" means an establishment for the <br />purpose of supplying limited personal services such as, <br />but not limited to, barbershops, shoe shops, boot shops, <br />or beauty shops, OR A FACILITY OPERATED BY AN ACCREDITED <br />MASSAGE THERAPIST FOR THE PURPOSES OF MASSAGE THERAPY, AS <br />DEFINED BY SECTION 5.16.010.C, LOUISVILLE MUNICIPAL CODE. <br /> <br />Section 2. If any portion of this ordinance is held to be <br />invalid for any reason, such decision shall not affect the validity <br />of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each <br />part hereof irrespective of the fact that anyone part be declared <br />invalid. <br /> <br />Section 3. The repeal or modification of any provision of <br />the Municipal Code of the City of Louisville by this ordinance <br />shall not release, extinguish, alter, modify, or change in whole or <br /> <br />1 <br />
