<br />AN ORDINANCE VACATING AN ALLEY LOCATED
<br />LOUISVILLE HEIGHTS SUBDIVISION, CITY OF
<br />COLORADO.
<br />
<br />IN BLOCK 3 ,
<br />LOUISVILLE,
<br />
<br />WHEREAS, certain property owners have requested that the alley
<br />located in Block 3, LOUISVILLE HEIGHTS subdivision, adjoining their
<br />property be vacated to them; and
<br />
<br />WHEREAS, the City Council has determined that such alley is
<br />not used or required as a thoroughfare for the public or for any
<br />public use, except for an easement as provided herein, and the
<br />vacation of such alley will not result in any lot or tract being
<br />without access to the public street system; and
<br />
<br />WHEREAS, the City desires to maintain a right-of-way and an
<br />easement in the alley; and
<br />
<br />WHEREAS, the vacation of the alley is in the best interests of
<br />the City and the public.
<br />
<br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
<br />OF LOUISVILLE, COLORADO:
<br />
<br />Section 1. The alley described below is hereby vacated,
<br />subject to the easements and rights-of-way described in Section 2
<br />and Section 3 of this Ordinance, and the title thereto shall vest
<br />as provided by law:
<br />
<br />The alley abutting Lots 1 through 12 inclusive, Block 3,
<br />LOUISVILLE HEIGHTS, County of Boulder, State of Colorado
<br />as recorded in Book 2, Page 226; in the office of the
<br />Clerk and Recorder, Boulder County, State of Colorado.
<br />
<br />Section 2.

<br />Section 3. The City hereby reserves from the property

<br />drainage, sewer, gas, water and similar pipes, appurtenances,
<br />lines, conduits, mains, or other facilities now or hereafter
<br />located in the rights-of-way vacated by this Ordinance, together
<br />with the right of ingress and egress in and to, over, under and
