WHEREAS, BCHA, LHA, the City, and the County have negotiated the proposed IGA <br />to address these concerns and further the provision of affordable housing in Louisville; and <br />WHEREAS, pursuant to proposed IGA, LHA's assets and outstanding debts will be <br />transferred to BCHA and BCHA shall, for the Commitment Term defined in the IGA, operate in <br />and provide affordable units within the City of Louisville, as provided in said IGA; and <br />WHEREAS, to further the purposes of the IGA and pursuant to C.R.S. § 29 -4 -508, the <br />BCHA has requested authority pursuant to State law to operate within the municipal boundaries <br />of the City of Louisville; and <br />WHEREAS, the City Council finds that the City is located entirely within the County of <br />Boulder, that the Board of County Commissioners of the County of Boulder have created the <br />BCHA for the purposes of providing housing to low and moderate income groups, and that <br />pursuant to C.R.S. § 29 -4 -508, the City Council as the governing body of the City may authorize, <br />by resolution, the inclusion of the City within the boundaries of the County Housing Authority; <br />and <br />WHEREAS, the City Council by this resolution desires to approve the proposed IGA <br />and authorize its execution, and authorize the inclusion of the City of Louisville to that area <br />under the jurisdiction of the BCHA; <br />NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO, THAT: <br />Section 1. The foregoing recitals are hereby incorporated into this Resolution. <br />Section 2. The City Council hereby approves the proposed IGA between the LHA, <br />BCHA, the City, and the County in the form thereof accompanying this Resolution. <br />Section 3. The Mayor is hereby authorized to execute the IGA on behalf of the City <br />Council of the City of Louisville; provided, however, that the Mayor is hereby further authorized to <br />negotiate and approve such revisions to the IGA as the Mayor determines are necessary or desirable <br />for the protection of the City, so long as the essential terms and conditions of such IGA are not <br />altered. <br />Section 4. The Mayor, City Manager, City Clerk, and City staff are hereby <br />authorized to execute all documents and do all other things necessary on behalf of the City to <br />perform the obligations of the City under the IGA. <br />Section 5. Effective upon the Effective Date of the IGA and for the Commitment <br />Term (each as defined in the IGA), the City of Louisville shall be within the boundaries of the <br />Boulder County Housing Authority pursuant to C.R.S. § 29 -4 -508. For such Commitment Term, <br />the Boulder County Housing Authority is authorized and empowered to operate within the City <br />of Louisville pursuant to Colorado Statutes. This authorization shall not be construed to change <br />any terms or provisions of the IGA. <br />Resolution No. 55. Series 2012 <br />Page 2 of 3 <br />
