6"/ #01494637 01/26/95 03:19 PM REAL ESTATE RECORDS F2033 CHARLOTTE HOUSTON BOULDER CNTY CO RECORDER ORDINANCE NO. 1179 SERIES OF 1995 AN ORDINANCE APPROVING THE ANNEXATION OF UNINCORPORATED LAND OWNED BY THE CITY OF LOUISVILLE, KNOWN AS THE LOUISVILLE SPORTS COMPLEX ANNEXATION, TO THE CITY OF LOUISVILLE, COLORADO AND DECLARING AN EMERGENCY WHEREAS, the City of Louisville is the sole owner of unincorporated territory, described in Exhibit A attached hereto, and the City Council of the City of Louisville desires to annex said municipally-owned land, to be known as the Louisville Sports Complex Annexation, to the City; and ~/ I ./ WHEREAS: said territory proposed to be annexed is not solely a public street or right-of-way; and WHEREAS, four (4) copies of an annexation map of the area have been prepared and filed with the City Council; and WHEREAS, not less than one-sixth of the perimeter of the area proposed to be annexed is contiguous with the City of Louisville as required by C.R.S. ~31-12-104; and WHEREAS, the area proposed to be annexed is integrated with or ~s capable of being integrated with the City of Louisville; and WHEREAS, the annexation of the territory proposed to be annexed will not result in the detachment of area from any school district; and WHEREAS, the annexation of the territory proposed to be annexed will not have the effect of extending the boundary of the City of Louisville more than three miles in any direction from any point of the boundary of the City of Louisville in anyone year; and WHEREAS, the City has a plan in place, pursuant to C.R.S. ~31- 12-105(1)(e); and WHEREAS, the Council, by resolution, has expressed its intent to annex the territory and determined that the annexation complies with the applicable laws of the State of Colorado, and that the area proposed to be annexed is eligible for annexation. WHEREAS, the City Council declares that an emergency exists because the City has determined that the timely development of the property to provide for ball fields and to accommodate recreational use during the summer of 1995 requires that the City acquire jurisdiction over the property without unnecessary delay. 1 cl-'}
