<br />City Council <br />Special Meeting Minutes <br />October 25, 2005 <br />Page 4 of 7 <br /> <br />Council member Keany responded to Susan Morris's question of Council by <br />stating he wished he would have encouraged Council member Van Pelt to <br />disclose more fully the nature of the conflict and to recuse herself and leave the <br />meetings. He stated his disservice to Council member Van Pelt and to the City <br />was he did not urge her to follow the procedure outlined in the Ethics Code. <br /> <br />Mayor Sisk took responsibility for not asking Council member Van Pelt to <br />disclose the reason for her conflict of interest and to leave the room. He stated <br />the Council has used Advisory Judges for opinions on ethics questions and will <br />continue to use unbiased jurists in ethics matters. He voiced his respect for <br />Council member Van Pelt and stated it is unfortunate it had to come to an ethics <br />code complaint. He addressed the ethics training proposed in the recommended <br />disposition and viewed it as an opportunity to reeducate the Council. He fully <br />supported the disposition offered by Mr. Josephsohn. <br /> <br />Mayor Sisk requested public comment. There were no comments. <br /> <br />Special Prosecutor Josephsohn emphasized the Council members are good, <br />honest people. He viewed ethics training as an invitation to improve the <br />Council's awareness of ethics. He noted no one is perfect and reeducation and <br />training benefits everyone. He stated Council member Van Pelt eagerly <br />accepted the opportunity to attend ethics training. He asked this not be <br />considered penal but reeducation. <br /> <br />City Attorney Light outlined the process, which the City followed, pursuant to the <br />Ethics Code. The complaint was filed with the City's Prosecuting Attorney, who <br />referred the matter to an advisory judge. The advisory judge appointed Mr. <br />Josephsohn as Special Prosecutor. <br /> <br />MOTION: Mayor Sisk moved the findings and proposed disposition of the ethics <br />complaint against Council member Van Pelt be approved, seconded by Council <br />member Marsella. Roll call vote was taken. The motion carried by a vote of 5-0. <br />Recused: Council member Van Pelt. Absent: Council member Brown. <br /> <br />2006 PROPOSED BUDGET - public hearing (continued from 10118/05- <br />advertised Daily Camera 10/15/05) <br /> <br />Council member Van Pelt returned to the meeting at 8:05 p.m. <br /> <br />Mayor Sisk opened the public hearing and requested Staff introduction. <br /> <br />City Manager Simmons presented the 2006 proposed budget. The projected <br />property tax revenue is $2,646,273. The 2006 projected sales tax revenue is <br />$9,876,887. The 2006 General Fund Revenues total $13,240,241 and the <br />Expenses total $13,212,976. The beginning cash in the general fund, special <br />
