City Council <br /> Meeting Minutes <br /> August 21, 2012 <br /> Page 4 of 23 <br /> Should Council decide to waive the 15% land dedication fee, staff can add a condition <br /> to the Resolution. Staff recommended Council approval on Resolution No. 54, Series <br /> 2012; Ordinance No.1619 and Ordinance No. 1620, Series 2012 on final readings. <br /> Council member Loo asked for clarification on the required fees; application fee and <br /> land dedication. She asked for the cost of an annexation application. Planner I <br /> Robinson stated the cost is $6,190.00. Council member Loo asked for the amount of fee <br /> in-lieu of land dedication. Planner I Robinson stated the applicant would be required to <br /> get an appraisal to set the value, which would then be assessed at 15% for the fee in <br /> lieu of land dedication. <br /> APPLICANT PRESENTATION <br /> Robert Kline, 895 Trail Ridge Drive, Louisville, CO explained when they purchased the <br /> property they did not have a full understanding of the process. Although the City staff <br /> was very helpful, they had to pay a lot of fees and the process has been very onerous. <br /> Now knowing the process, they may not have taken the same route. He requested the <br /> 15% land dedication fee be waived. <br /> Council member Loo asked the applicant why they are annexing to the City. Mr. Kline <br /> explained they wanted to add on to the property, not knowing this lot and a neighboring <br /> lot are in Boulder County. This was discovered when the previous owner had a water <br /> break in the basement and when she asked the city for some relief on the water bill, it <br /> was discovered the property was in the County and the two properties were subject to <br /> paying outside water rates. Mr. Kline stated they prefer to be in the City of Louisville. <br /> Andy Johnson, DAJ Design, 817 Pine Street, Louisville, CO stated the property sits well <br /> within the city limits of the City of Louisville. It has improvements permits, paid to and <br /> inspected by Louisville Building Department. The applicant's objective was to move <br /> forward with a voluntary annexation application, which has been onerous and an <br /> expensive process. He explained this very small house dates back to the1940's and is <br /> in need of improvements. The land dedication fee could impair the ability to redevelop <br /> the property. He felt the zoning process to be onerous and constrictive. <br /> PUBLIC COMMENT <br /> Robert Sandford, 322 S. Jefferson Avenue, Louisville, CO noted the City Council offers <br /> assistance to businesses and asked why such assistance cannot be provided to <br /> citizens. He felt the City should set a precedent by waiving the fees. Mayor Muckle <br /> explained the City's Business Assistance Program offers incentives to bring new <br /> businesses to the City. He welcomed the Kline's to a new part of town. <br /> Karen Kline, 815 Trail Ridge Drive, Louisville, CO stated the expense of annexing a <br /> single home in the City is too high for an individual property owner. She urged Council <br /> to look at the process. <br />
