Louisville City Council Meeting <br />March 6, 2001 <br />Page 11 <br /> <br />Davidson stated that he took exception to the statements in the Xcel filing that the City <br />was intentionally delaying the process. He asked Diehl how PSCo reached that <br />conclusion. Diehl stated the conclusion was based on time-lines and witness testimony. <br /> <br />Sisk asked Diehl if the citizens of Louisville voted to have the lines buried, would Xcel <br />contribute the cost of the poles toward the under grounding. Diehl stated that the 1.5 <br />million dollar estimate, was the cost to build the overhead line, and the 2.8 million dollar <br />estimate was the cost PSCo agreed to, in order to build the most expensive above ground <br />alternative. Diehl stated that before October, PSCo agreed to build the 2.8 million dollar <br />alternative. <br /> <br />Sisk stated that he would like to see Xcel (PSCo) work with the City and explore the <br />possibility of burying the lines. Diehl stated that there may have to be a determination of <br />whether franchise fees can be contributed toward the burial of the lines. Diehl noted that <br />due to peak needs in the summer of 2001, Xcel will build an above ground line. <br /> <br />Keany stated that Mr. Gheleta referenced a new substation would be built at Interlocken <br />and the existing line running through Louisville would only be needed during the peak- <br />demand of the summer of 2001. He asked Mr. Diehl if that was an accurate statement. <br />Diehl stated that was not an accurate statement. He explained that the PUC and PUC <br />Staff agreed that the line needs to be built prior to this summer's peak demand. He stated <br />that Interlocken may or may not move to another line, and based on PSCo load <br />projections, the PUC agreed that the upgrade was needed. <br /> <br />COUNCIL COMMENTS <br /> <br />Keany stated that he could not support PSCo's Special Review Use application because it <br />did not meet the criteria of a Special Review Use. He stated that he would support all the <br />conditions set forth in Resolution No. 16, Series 2001, Alternate A. <br /> <br />Davidson concurred with Councilman Keany, however, he stated that a court will find <br />that PSCo's right-of-way is grand fathered and find in favor of PSCO. He supported the <br />conditions in Resolution No. 16, Series 2001, Alternate A. He stated his belief that PSCo <br />should rent or acquire the equipment to monitor EMF and noise levels. <br /> <br />Howard concurred with Mayor Davidson's comments and stated that he did not want to <br />see the poles moved within the residential areas. He also stated his belief that the EMF <br />and noise levels should be monitored He stated that he would support the Special <br />Review Use with the Planning Commission's recommended conditions. <br /> <br />Brown stated that the entire process of the PSCo Special Review Use application has <br />been frustrating. He stated that the City might set a bad precedent by pursuing this matter <br />in court.
