Louisville City Council Meeting <br />March 6, 2001 <br />Page 5 <br /> <br />Wood stated that Resolution No. 16, Series 2001 recommends disapproval of the PSCo <br />Special Review Use application, which is consistent with the Planning Commission <br />recommendation. He stated that if Council wishes to add conditions, they should be noted <br />in the motion. Council may also continue any action on Resolution No. 16, Series 2001 <br />and direct staff to prepare additional findings and conclusions. Alternatively, if Council <br />desires to approve the Special Review Use for Xcel Energy, they may adopt Resolution <br />No. 16, Series 2001 Alternate A. <br /> <br />Davidson called for Applicant presentation. <br /> <br />Michael Diehl, 550 15th Street, Suite 700, Denver, CO, representing PSCo, summarized <br />the Special Review Use application process since the fall of 2000. He stated that PSCo <br />presented a series of alternate rights-of-way and evaluated each on 15 different criteria. <br />He noted that they received many suggestions from the public and staff. He stated that the <br />conclusion reached by PSCo was to reconstruct the line in its existing location. He stated <br />that the public has generally accepted the single pole. He noted that, in this particular <br />environment, the pole would simulate the color of wood. <br /> <br />Diehl stated that he wished to correct lp of the findings of Resolution No. 16, which <br />indicates that "rerouting of the load serving path is technically feasible and that there <br />may be excess capacity in the existing 230 kV line west of the City of Louisville." <br />He noted that PSCo did propose a resolution to the Public Utility Commission by <br />requesting a declaratory judgment to provide an outside, independent state agency with <br />electrical transmission expertise. He stated that the information obtained would be <br />forwarded to the City of Louisville. <br /> <br />Diehl stated that PSCo filed a petition with the Public Utilities Commission. The PUC <br />entered an oral ruling on February 14, 2001 that the upgrade of the transmission line <br />between Boulder and Broomfield is needed. He stated that a PUC press release ordered <br />PSCo to upgrade of the line by the summer of 2001 to ensure adequate and reliable <br />electric service to the US 36 corridor. He stated that PSCo has a statutory duty to comply <br />with the PUC order and the rerouting of the line is not a current viable option. <br />Implementation of alternative construction designs will not allow PSCo to fulfill the PUC <br />order to construct necessary improvements to avoid potential 2001 summer-peak electric <br />reliability problems. Diehl stated that for those reasons, PSCo respectfully requests that <br />the City of Louisville adopt Resolution No. 16, Series 2001, Alternate A, with some <br />adjustments to the conditions.
