SECOND AMENDMENT TO HOME CONSORTIUM INTERGOVERNMENTAL <br />AGREEMENT <br />This Second Amendment to the HOME Consortium Intergovernmental <br />Agreement is made as of the Z`J-t `day of la ■-fc__ , 20Lby and between the City <br />and County of Broomfield, Boulder County, the cities of Longmont, Lafayette and Louisville, <br />the towns of Lyons, Superior, Jamestown, Nederland, Ward and Erie (collectively the <br />"Participating Governments "), and the City of Boulder (the "Lead Agency "). <br />RECITALS <br />WHEREAS, the United States Government, through the National Affordable Housing <br />Act of 1930, has established the HOME Investment Partnerships Act Program ( "HOME" or <br />"HOME Program "); and <br />WHEREAS, the City of Boulder, the City of Longmont, the City and County of <br />Broomfield, and Boulder County ( "HOME Consortium ") entered into a HOME Consortium <br />Intergovernmental Agreement dated June 27, 2006, to bring additional funds to the region for the <br />purpose of expansion and rehabilitation of the supply of decent, safe, sanitary, and affordable <br />housing and to strengthen partnerships among all levels of government and the private sector; <br />and <br />WHEREAS, the HOME Consortium Intergovernmental Agreement was amended by <br />Amendment No. 1 to HOME Consortium Intergovernmental Agreement, dated as of July 20, <br />2007, which added the cities of Lafayette and Louisville and the towns of Lyons, Superior, <br />Jamestown, Nederland, Ward and Erie (collectively the "Intergovernmental Agreement "); and <br />WHEREAS, participation in the HOME Consortium will enhance cooperation between <br />jurisdictions and will maximize the use of resources available to local governments to affect the <br />housing - related problems of lower- income people; and <br />WHEREAS, the parties wish to further amend the terms of the Intergovernmental <br />Agreement and to clarify the promises and obligations of the parties. <br />NOW THEREFORE, in consideration of the promises and obligations set forth below, <br />the parties agree to further amend the Agreement as follows: <br />1. The parties agree to abide by the terms of the Intergovernmental Agreement, <br />except as modified by this Second Amendment. <br />2.
