<br />RESOLUTION 61, SERIES 1995 <br /> <br />A Resolution to join the Boulder County Solid Waste, Recycling and Composting <br />Authority <br /> <br />WHEREAS, the City of Louisville supports efforts to recycle and compost materials; and <br /> <br />WHEREAS, Boulder County voters approved a sales tax increase to create recycling and <br />compo sting facilities; and <br /> <br />WHEREAS, the Solid Waste, Recycling and Composting Authority has amended the bylaws of <br />the Intergovernmental Agreement to include Section 16 which states that any decision to accept <br />wastes which are exempt from regulation as hazardous wastes under state and federal law may <br />only occur as part of the Authority's annual budget process, and shall not be effective until <br />January 1 of the following year; and <br /> <br />WHEREAS, Section 16 further states that any amendment or repeal of this provision of the <br />by-laws may only occur as a part of the Authority's annual budget process, and shall not be <br />effective until January 1 of the following year. <br /> <br />NOW THEREFORE, be it resolved, the City Council of the City of Louisville, Colorado, <br />does hereby approve the Intergovernmental Agreement Concerning Solid Waste Management, <br />Recycling, and Composting and authorizes the Mayor to enter into the said Intergovernmental <br />Agreement with the condition that Section 16 is included in and remains in the by-laws; and <br />should Section 16 be amended or repealed by the SWRCA, Louisville would retain the ability <br />to withdraw from the Authority immediately. <br /> <br />PASSED AND ADOPTED THIS 17th day of October, 1995. <br /> <br />~/:;';" D~ <br /> <br />Mayor Tom Davidson <br /> <br />ATTEST: <br /> <br />
