City Council
Meeting Minutes
June 19, 2012
The fifth change is an amendment to the allowed uses in PCZD -C zone districts in
Section 17.72.090 to allow limited wholesale sales as a special review use as follows
(words to be added are underlined):
Sec. 17.72.090. Commercial and office
B. Uses permitted. The following commercial and noncommercial uses
may be permitted within any planning area designated "commercial" on
the adopted planned community development general plan:
Add
20. Limited wholesale sales as defined in section 17.08.262 of this title
are allowed as a special review use.
These changes would implement the policy outlined by allowing limited wholesale sales
as a special review use accessory to a primary retail /restaurant use in the CC, MU -CC,
and PCZD -C zone districts.
PUBLIC COMMENT
Mayor Muckle called for public comment and hearing none, asked for Council comment.
COUNCIL COMMENT
Council member Keany questioned not allowing wholesale as a primary use and
foresees the potential for wholesale to exceed retail. Planner Robinson maintained the
business would then have the possibility to move wholesale to CTC or a zone district
where allowed.
Planning Director Russ addressed the ability for special review. He indicated the
owners would be making a business decision when opening a business downtown and
would have to understand the intent to keep downtown a pedestrian /retail community.
Council member Sackett asked if staff was aware of opposition. Planner Robinson
stated no negative public comment had been received.
Mayor Pro Tem Dalton asked if under special review could there be more wholesale
than retail. The answer was wholesale must remain secondary to the retail.
Council member Keany didn't want to chase away viable businesses that might not be
in compliance currently and wanted a way to address variances. Attorney Light stated
the Board of Adjustment makes use interpretations. Principal use is not the scope of
this ordinance but wholesaling as an accessory or subordinate use. The principal uses
may be another discussion.
Mayor Muckle called for public comment and hearing none, closed the public hearing.
26
