COUNCIL COMMUNICATION <br />TO: MAYOR AND CITY COUNCIL <br />FROM: MALCOLM FLEMING, CITY MANAGER <br />DATE: JULY 10, 2012 <br />SUBJECT:UPDATE/DISCUSSION - PUBLIC NOTIFICATION PROCEDURES <br />ORIGINATING DEPARTMENT:PLANNING AND BUILDING SAFETY DEPARTMENT <br />SUMMARY: <br />Concerns were raised during the initial stages of the Safeway Redevelopment review process <br />that the City’s notification procedures for quasi-judicial land development requests did not <br />adequately notify the community given the size and scale of the Safeway development request. <br />As a result, the City Council asked staff to evaluate modifying the City’spublic notice <br />requirements for quasi-judicial land development requests. Based on this direction,staff <br />reviewed the City’s Home Rule Charter and the Louisville Municipal Code’s (LMC) public <br />notification requirementsand identified minor procedural inconsistencies between various <br />development review categories. Staff will review these issues with Council and consider <br />Council and public comments to determine the scale of effort appropriate to improve the public <br />notification processes. <br />CURRENT PROCEDURES: <br />There are specific rules the City and applicants must follow to provide public notificationof <br />quasi-judicial land development proposals. The Louisville Home Rule Charter and the Louisville <br />Municipal Code (LMC) outline specific public notification requirementsfor various land <br />development requests. <br />It is important to note these public notification requirementsare not minimum requirements. <br />They are requirements the City and applicant must follow and not deviatein order tocreate a <br />fair and consistent procedure for each request so the applicant and interested citizens can be <br />properly notified and informed.Four notifications actions are currently used by the City: <br />1)Mailing a notice to adjacent and nearby property owners (up to 500feetfrom the <br />project); <br />2)Publishingthe notice in a local news paper (City uses the Boulder Daily Camera); <br />3)Posting the notice in public places (City posts at City Hall, Library, Police & Municipal <br />Court Building, the Recreation Center; and on the City Web-site; <br />4)Posting the notice on the subject property. <br />Staff reviewed the public notification requirements of twelvequasi-judicial land development <br />requests.
