COUNCIL COMMUNICATION <br />TO: MAYOR AND CITY COUNCIL <br />FROM: MALCOLM FLEMING, CITY MANAGER <br />DATE: AUGUST 28, 2012 <br />SUBJECT: UPDATE /DISCUSSION — BOARD OF ADJUSTMENT (BOA) <br />ORIGINATING DEPARTMENT: PLANNING AND BUILDING SAFETY DEPARTMENT <br />ON BEHALF OF THE BOA <br />INTRODUCTION: <br />The Board of Adjustment (BOA) is a six member quasi-judicial board that hears and decides <br />requests for variances from the City's zoning ordinance. The BOA also hears and decides <br />floodplain development permits and appeals of administrative zoning and floodplain decisions. <br />BOARD MEMBERS: <br />The current board members are: Chris Fuller, Chair; Larry Brassem, Vice - chair; Erik Jasiak, <br />James Stuart, and Leslie Ewy. Kirk Watson serves as the associate or alternate member. <br />There is currently one vacant full time position on the Board of Adjustment. <br />2011 SUMMARY: <br />The BOA heard six variance requests in 2011. The Board of Adjustment is the review body for <br />all development in the FEMA designated floodplain and two of the six hearings in 2011 were for <br />floodplain development permits. Two of the cases dealt with variances to setback <br />requirements. The last two cases were for variances to the maximum fence height requirement <br />and vision clearance requirement. All of the cases heard by the Board of Adjustment in 2011 <br />were approved.
