The private drive would be <br />maintained by a joint access agreement. He noted that the two access concept is a result <br />of maximizing the public open space. Spare stated that that they have worked with <br />engineers on the alignment of the private drive in relationship to the bike path. <br /> <br />Spare stated that the Fischers will dedicate 39% of the land for Open Space, <br />approximately 3 acres, to the City of Louisville without cost. He noted that does not <br />include areas for detention, which would be 4% of the site. He stated that they have <br />increased the north buffer along the property line to 30' wide, allowing the existing ditch <br />and its large trees to remain, thus preserving the rural character at that location. Sparn <br />introduced Mr. Charles Keim, the engineer for the project, who would address any <br />technical questions. He ensured Council that the applicant has gone to extraordinary <br />levels of detail with the City's Planning and Public Works Staff to establish the quality <br />and viability of the concept. He requested that Council approve the Fischer Annexation <br />Agreement. <br /> <br />Howard opened the public heating and asked if anyone in the audience wished to speak <br />in favor or against Ordinance No. 1345, Series 2000. <br /> <br />PUBLIC COMMENT <br /> <br />Donna Wicker, 315 Walnut Lane, Louisville, CO, stated that she supported the Fischer <br />Annexation Agreement. She stated her belief that the 24% dedication of open space, <br />without cost, in addition to the required 15% is a generous gift. She supported the <br />Annexation Agreement condition for amendment in the PUD process. She encouraged <br />Council to approve the Fischer Annexation Agreement. <br /> <br />Ted Hine, 318 South Place, Louisville, CO, reviewed an email that he had directed to <br />each of the City Council members. He stated that Council approval of the Fischer <br />Annexation Agreement will ultimately result in a referendum and a special election held <br />in the summer or fall. He offered several suggestions to the Annexation Agreement and <br />the Diagram. He stated that the development will severely obscure his right of sight and <br />put second story windows directly and closely in his view. Hine introduced an alternate <br />sketch that would substantially reduce the impact, without changing the overall design <br />philosophy. He stated that one of the provisions in the Annexation Agreement must be <br />slightly modified. He requested that the phrase "the majority of open space shall be <br />located on the west side of property" be changed to "located on the north end or west <br />side of property". <br /> <br />Fred Banta, 370 W. Spruce Lane, Louisville, CO, stated that in review of the Fischer <br />Annexation process, people have looked at the issues from different perspectives. Some <br />from a personal standpoint as property owners, and others in a larger context as it relates <br />to the City.
