Louisville City Council Meeting <br />March 20, 2001 <br />Page 8 <br /> <br />Planning Commission is required. He stated his preference to go forward with the <br />annexation and zoning. He stressed the importance of proper planning and protecting the <br />interest of all the citizens of Louisville. He voiced his belief that Council should adhere <br />to the normal planning process. He stated that the annexation agreement is premature and <br />should await the PUD process. <br /> <br />Brown stated that this is a special circumstance, and that he recognized that there is a <br />challenge in changing the prescribed procedures. He noted that this particular <br />development, with the special circumstances and conditions, has been a good example of <br />community cooperation. He stated that he was comfortable in moving forward. He <br />offered a proposal for Council to consider an amendment to allow for flexibility in <br />paragraph 16.e He suggested that after the end of the last sentence, the following phrase <br />be added: "provided that a determination of substantial compliance, considering safety, <br />municipal, physical and other issues that may arise during the PUD process." He stated <br />that phrasing would allow the flexibility to amend the plan based on safety concerns, <br />while giving the citizens recognition for their hard work in negotiating the agreement. <br /> <br />Howard asked Planning Director Wood and Public Works Director Phare how much time <br />was spent on the sketch plan. Wood stated that a substantial amount of time was devoted <br />to this project and estimated over 60 hours. <br /> <br />Howard asked Mr. Hine about his concern as to the location of the open space dedication. <br />He asked if the issue was not addressed at tonight's meeting, would that reduce his fear <br />of losing his right to challenge the location of the open space dedication. Howard <br />suggested striking the section that referred to "The majority of such open space shall be <br />located on the west side of the Property, as depicted on Exhibit C." <br /> <br />Hine stated that it was a step in the right direction, however it does not guarantee that it <br />would become a reality. <br /> <br />Howard stated that Council could not guarantee anything until the PUD process is <br />completed and that he was proposing an opportunity to present fairness to all concerns. <br /> <br />Hine stated that if his words were incorporated into the agreement it would be a <br />significant step in the right direction, in the direction of fairness. He stated that could be <br />an option and discussed during the PUD process. <br /> <br />Howard asked the applicant if striking that provision would cause concern. <br /> <br />Spam stated that at the neighborhood meeting there was a consensus that the community <br />would get the most benefit if the open space were located on the west side. He noted that <br />they have added an additional 10 feet on the north. Sparn stated that the applicant could <br />live with the change. <br /> <br /> <br />
