<br />RESOLUTION NO. 56 <br />SERIES 1995 <br /> <br />A RESOLUTION RELATING TO THE ISSUANCE OF BUILDING PERMITS <br />AND CERTIFICATES OF OCCUPANCY IN THE MEADOWS AT COAL <br />o.EEK SUBDIVISION. <br /> <br />WHEREAS, Paragraph 8.2 of The Meadows at Coal Creek <br />Subdivision Agreement states: <br /> <br />8.2 Elimination of Gas Well Facilitv. In Phase Three of <br />the development, Subdivider agrees to properly close, at <br />Subdivider's expense, the gas well in Outlot L, to remove <br />the above ground equipment and to ensure that the site is <br />safe for re-vegetation and public use. <br /> <br />WHEREAS, Subdivider, The Meadows at Coal Creek Corporation, <br />requested construction acceptance of Phase Three on July 24, 1995, <br />and the gas well in Outlot L has not been closed and the above <br />ground equipment has not been removed; and <br /> <br />WHEREAS, in a letter to the Mayor, Council and Planning <br />Commission Members dated May 22, 1992 (see attached), requesting <br />their consideration of the Final Plat and PUD Plan on The Meadows <br />at Coal Creek Subdivision, representatives of the Subdivider <br />represented that the gas well located on Outlot L would be <br />eliminated by April I, 1995 or earlier; and <br /> <br />WHEREAS, on a "CITY OF LOUISVILLE FACT SHEET", dated August <br />28, 1992, the Subdivider requested annexation, zoning, final POD <br />Development Plan, and Subdivision Plat (see attached), and stated <br />therein that the !Iowner has committed to acquire and cap the gas <br />well at a cost to the owner of $110,000. This removes a hazard to <br />the community-at-Iarge. After it is capped and cleaned up the well <br />site will then become part of the dedicated park area.llj and <br /> <br />WHEREAS, by letter dated December 3, 1993, the Subdivider <br />stated to the City that the Subdivider had notified the owner of <br />the gas well, Gerrity Oil and Gas Corp., that they must have the <br />gas well abandoned by April 8, 1994: <br /> <br />They then have a reasonable amount of time to remove the <br />equipment.
