<br />RESOLUTION NO. 43 <br />SERIES 1995 <br /> <br />A RESOLUTION APPROVING A FINAL SUBDIVISION PLAT AND <br />A FINAL PUD DEVELOPMENT PLAN FOR McKINLEY PARK <br /> <br />WHEREAS, there has been submitted to the Louisville City Council by Wonderland Hill <br />Development Company, a request for approval of a Final Subdivision Plat and a Final PUD <br />Development Plan; and, <br /> <br />WHEREAS, all material related to the Final Subdivision Plat and Final PUD Development <br />Plan, have been reviewed in conjunction with the Louisville zoning ordinances, subdivision <br />regulations, PUD regulations and related policies; and, <br /> <br />WHEREAS, after a properly advertised public hearing concerning and Final Subdivision <br />Plat and Final PUD Development Plan, the Planning Commission recommends approval to the <br />City Council with conditions; and, <br /> <br />WHEREAS, the City Council finds that said Final Subdivision Plat and Final PUD <br />Development Plan for McKinley Park, should be approved with the following conditions: <br /> <br />1. Homeowners documents shall be submitted for staff review prior to <br />recording the final PUD. <br /> <br />2. Strike the following notes on the PUD: <br />a. Building setback from both side lot lines must total minimum of 25'. <br />b. Stamped concrete typical. <br /> <br />3. Delete street sections from the PUD development plan. <br /> <br />4. Delete driveway location shown for lot 9. <br /> <br />5. Trees on private property shall be deletedfrom PUD and instead provided for by <br />covenant. <br /> <br />6. Note No Parking on cui de sac on PUD. The extent of the No Parking zone to be <br />worked out between the Public Works Director and the Developer. <br /> <br />7. Landscaping in Outlot 4 shall be maintained by Homeowners Association. <br /> <br />8. Cost of City contribution to park improvements shall not exceed service expansion <br />fees generated by this subdivision. <br />
