City Council <br />Meeting Minutes <br />November 20, 2012 <br />Page 7 of 15 <br />Council member Jasiak asked if the application was denied, could the applicant <br />resubmit his application. City Attorney Light confirmed the applicant could re -file his <br />application, but noted the application cannot be denied yet provide conditions that <br />guarantee future approval. <br />PUBLIC COMMENT <br />Mr. Poppitz asked if he would be reimbursed. He wanted to reroof, reside and install <br />custom windows and totally restore the exterior. He would not request HPC funds for <br />the home's interior. <br />Michael Menaker, 1827 Choke Cherry Drive, Louisville, CO concurred with staff's <br />recommendation. He did not feel the home had the architecture integrity. He agreed the <br />social history is more important than the structure. He urged support for staff's <br />recommendation. <br />Council member Keany inquired about the retroactive repayment. Planning Director <br />Russ stated the code does not allow for reimbursement for a structure improvement <br />prior to landmarking. <br />Council member Loo voiced her appreciation of the people who came forward in <br />support of landmarking this home. She noted the City will make significant financial <br />contributions to the Grain Elevator and suggested a higher standard for HPC funds. <br />MOTION: Mayor Muckle moved to approve Resolution No. 76, Series 2012, seconded <br />by Council member Yarnell. <br />Council member Keany asked if there is an ability to make retroactive payments. <br />Planning Director Russ agreed the applicant may reapply, but the Louisville Municipal <br />Code does not allow for funds to be saved or set aside for a home which could be <br />landmarked in the future or reimburse a home that is not currently designated as a <br />landmark. <br />Mayor Pro Tem Dalton stated it was not a matter of money, but about landmarking <br />worthy properties. Council member Yarnell agreed it was not about money, but felt this <br />is significant because of the neighborhood piece. <br />Council member Jasiak asked Mr. Stewart whether there are better examples of other <br />miner homes. Mr. Stewart confirmed there are better examples of the miners' homes. <br />VOTE ON THE MOTION: The vote was 3 — 3. Council members Yarnell, Jasiak and <br />Mayor Muckle voted yes. Mayor Pro Tem Dalton, Council members Loo and Keany <br />voted no. Absent: Council member Sackett. A tie vote results in denial of the motion to <br />approve Resolution No. 76, Series 2012. <br />19 <br />
