Louisville City Council Meeting <br />May 22, 2001 <br />Page 2 <br /> <br />RECONSIDERATION OF RESOLUTION No. 16, SERIES 2001 - A <br />RESOLUTION APPROVING A SPECIAL REVIEW USE FOR PUBLIC <br />SERVICE COMPANY OF COLORADO TO UPGRADE AN EXISTING, ABOVE <br />GROUND, 115 KILOVOLT (kV) TRANSMISSION LINE - PROPOSED <br />REVISIONS TO CONDITIONS <br /> <br />Mayor Davidson explained that, during a telephone conversation with Sam Light, he <br />asked Sam to add a condition of approval that is not included in the City Council packet <br />materials. Davidson asked Sam Light to read the additional condition of approval. <br /> <br />Sam Light explained that there is a suggested revision to Resolution No. 28, Series 2001, <br />which has been discussed with the attorneys for Public Service Company. On condition <br />B, dealing with the location of structures, there would be an additional sentence added <br />stating as follows: Additionally, new pole number 39 shall be located north of the existing <br />pole if applicant's engineering allows for such location. Sam explained that this change <br />would potentially permit the relocation of pole number 39. He stated that he was not <br />exactly certain where pole number 39 was located. <br /> <br />Bill Simmons, City Administrator, explained that pole 39 is located in the Meadows at <br />Coal Creek subdivision. <br /> <br />Sam Light explained that the additional condition would allow the pole to be moved <br />north of its existing location. He stated that on March 16, 2001, City Council passed <br />Resolution No. 16, Series 2001, approving Public Service Company's Special Review <br />Use request to upgrade the existing 115 kV transmission line. Resolution No. 28, Series <br />2001 is intended to revise certain conditions set forth in Resolution No. 16, Series 2001~ <br />A copy of that resolution, along with a copy of the public notice for consideration of <br />Resolution No. 28, Series 2001, is included in the City Council packet materials. Light <br />explained that notice of tonight's heating was published in the Daily Camera on May 19, <br />2001 and posted in the lobby at City Hall, pursuant to State Statute and the Louisville <br />Municipal Code. He stated that Resolution No. 28, Series 2001 contains the following <br />changes to the prior conditions of approval: (verbatim) There is currently a condition <br />granting the Mayor the discretion to approve adjustments in the locations of up to six <br />poles, the change would increase that number from six poles to ten poles, granting the <br />Mayor the authority, at his discretion, to approve adjustments of up to eighty-five feet for <br />no more than ten poles. There would be some revisions to the height and restrictions that <br />are currently in the resolution. As you know, the current approval limits the height of the <br />new poles to eighty-nine feet. It has been determined that two of those poles, poles <br />number 25 and 32, need to exceed the eighty-nine foot height level. The applicant has <br />requested that those poles be allowed to be respectively lO0.5 feet and ninety-seven feet <br />from grade to the top of the poles. So the result of that change would be to allow two of <br />the poles to exceed the eighty-nine foot limit. Additionally, there would be a new <br />condition "N" added, stating that upon completion of the project, Xcel would provide to <br />the City a hand-held gauss meter that customers may use to measure EMF levels <br />themselves.
