Louisville City Council Meeting <br />May 22, 2001 <br />Page 6 <br />pole. He repeated that people are getting 'hung up' on one foot or two feet. He explained <br />that he has viewed the structure from a number of vantage points, including backyards, <br />and he did not feel that one foot or two feet would make a difference. <br /> <br />Sisk disagreed with Diehl's comment that one foot or two feet would not make a <br />difference. He stated that he feels everyone has come a long way on this issue. He agreed <br />that emotions are 'on our sleeves' but disagreed with the suggestion that Council can't <br />accommodate people who have come forth and remain objective. He suggested <br />dispensing with the rhetoric and agreed that the pole must be within five feet of the <br />existing pole. He commended Xcel for their display of good faith by removing the newly <br />installed pole this afternoon and encouraged the parties to move forward in a spirit of <br />continued cooperation. He explained that he voted for the project and he would like to see <br />it succeed. He expressed hope that this could be resolved. <br /> <br />Diehl committed that Xcel could get the new pole as close as physically possible to the <br />existing pole. <br /> <br />Brown asked Light for clarification that there have been no amendments to the <br />monitoring provisions that were in the original Special Review Use permit. <br /> <br />Light replied, yes, there would be condition "N" added which requires the monitoring <br />after the project is completed and on a semi-annual basis thereafter. <br /> <br />Brown stated that his agreement shows that as condition "M". <br /> <br />Light apologized and stated that condition "M" stays and the new condition "N" requires <br />that Public Service provide a hand-held gauss meter. <br /> <br />Brown stated that this has been an extremely difficult situation for everybody involved, <br />with an unsatisfying result. He expressed sympathy for the man who was injured working <br />on the project this evening~ He stated, however, that the City of Louisville has had <br />difficulty throughout this process getting any clear information from Xcel. He repeated <br />his frustration with the experience from the beginning and agreed that it appears that an <br />'uneasy peace' has been reached. He commended the Mayor for reaching a resolution <br />that allows the City to move forward without litigation and includes monitoring <br />provisions, which are almost unheard of. <br /> <br />Keany agreed with Brown and asked to also include City staff to the list of individuals <br />that have done an admirable job in dealing with a very difficult situation. <br /> <br />Davidson thanked Diehl for meeting everyone at the location of pole 39 and for being so <br />cooperative. <br /> <br />Light asked Gregory Sopkin, attorney for Public Service, if he had any additional <br />comments. <br /> <br />6 <br /> <br /> <br />
