<br />RESOLUTION NO. 73 a.. <br />SERIES 1994 <br /> <br />A RESOLUTION APPROVING A <br />FINAL SUBDIVISION REPLAT AND AN <br />AMENDMENT TO A FINAL PUD DEVELOPMENT PLAN FOR <br />THE ASPEN GREENS SUBDIVISION <br /> <br />WHEREAS, there has been submitted to the Louisville City Council by Regal Investment <br />Associates, Ltd. a request to approve a Final Subdivision Replat and an Amendment to a Final PUD <br />Development Plan for the Aspen Greens Subdivision; and, <br /> <br />WHEREAS, all materials related to the Final Subdivision Replat and Final PUD Development <br />Plan have been reviewed by City Staff and the Planning Commission and found to be in compliance <br />with the Louisville zoning ordinances, subdivision regulations, and related policies; and, <br /> <br />WHEREAS, after a properly advertised public hearing concerning said Final Subdivision <br />Replat and Final pun Development Plan, the Planning Commission recommended to the City <br />Council approval with conditions; <br /> <br />WHEREAS, the City Council finds that said Final Subdivision Replat and Final PUD <br />Development Plan for Aspen Greens should be approved subject to the following conditions; <br /> <br />1. Allow one joint identification, ground sign on South Boulder Road. The location of the <br />sign should be shown on the PUD Development Plan. <br /> <br />2. The applicant shall resolve the width o.l'the ingress and egress on South Boulder Road <br />with the Fire Marshal prior to the recording 0.1' the PUD Development Plan; <br /> <br />3. Outlot A, with exception o.l'the bike path, shall be maintained by the subdivider,' <br /> <br />4. Thefollowing not shall be added to the subdivision replat: <br /> <br />"Not more than 40% 0.1' total combined net square footage 0.1' building <br />1 01 and 102 shall be occupied by a medical/dental user. " <br />
