Louisville City Council Meeting <br />July 3, 2001 <br />Page 8 <br /> <br />Keany stated that there would be a potential through the open space dedication, to <br />provide for a connection from Dillon Road and St Andrews. Keany stated that based on <br />the discussion, he would like to visit the site and asked that the matter be continued. <br /> <br />Mayer asked Wood for clarification that the request is for one home on the site and asked <br />if the applicant could apply for a building permit without platting the subdivision. Wood <br />stated that even if it were only one lot, the property has to be platted in order to issue <br />building permits. <br /> <br />Mayer voiced concern that if there is no physical subdivision of the property, whether <br />any open space dedication is required. Wood stated that the subdivision process is <br />mandatory prior to the issuance of any building permits. He stated that can be required as <br />part of the annexation agreement. <br /> <br />Mayer stated that he would want to make sure that the open space dedication occurs. He <br />addressed the Open Space Advisory Board's review of this proposal and determination <br />that no conflict would occur, but that signage should be placed alerting users of the trail. <br />Mayer stated that was a conflicting statement, if no conflict is apparent there would be no <br />need for signage. He agreed with Mayor Davidson that it would be irregular to have <br />access across a city park and that it would not be in the City's interest. He explained that <br />properties are platted for the life of the land and not the current owners. He stated his <br />understanding that the current access off Dillon Road is unsafe, but in the long run, with a <br />couple of changes, access along Dillon Road would be preferable. He stated that it is <br />likely that Dillon Road will be realigned. He stated that most of Dillon Road coming <br />from the west has a median and that it is likely that there would be right in/right out <br />access. He suggested that the realignment of Dillon Road and the right in/right out access <br />would meet the requirements of providing owner access to a safe egress/ingress. He <br />voiced his belief that it did not make sense to tear up a park to provide access to a home. <br />He stated that it creates conflicts between motor vehicles and users of the trail. He <br />commented that a long-term plan may be to continue the trail to Dillon Road access. He <br />agreed with Mr. Mahaffy that the applicant could go to the County and be granted an <br />access, with certain restriction, off Dillon Road. <br /> <br />Levihn asked Wood if there are any other driveways that cross City trails. Wood stated <br />that in the immediate vicinity of Coal Creek/Rock Creek, off St. Andrews, the trail backs <br />up to the rear of some properties. He stated that he would further research that matter <br />further. <br /> <br />Levihn stated that he studied the area and has concerns with a driveway crossing the trail. <br /> <br />8 <br /> <br /> <br />
