City Council <br />Meeting Minutes <br />August 21, 2007 <br />Page 8 of 9 <br />City Attorney Light explained on July 6, 2007, the City Clerk received a petition <br />initiating a proposed ordinancE; entitled: "An Ordinance transferring authority from <br />the unelected Louisville Revitalization Commission to the Louisville City Council <br />and establishing procedures for the Louisville Urban Renewal Authority." She <br />found the petition contained a sufficient number of signatures and presented a <br />copy of the Statement of Sufficiency dated August 1, 2007. <br />On August 7, Council passed Resolution No. 37, Series 2007 confirming the City <br />Clerk is the City's designated official for purposes of fixing the ballot title for the <br />initiated measure. After adoption of Resolution, 37, Series 2007, a public hearing <br />on the ballot title was schedulE:d for Monday, August 13, 2007 at 11:00 a.m., and <br />notice of the hearing was posted at City Hall and on the City's Web Page. <br />The City Clerk conducted the public hearing on the ballot title and received <br />testimony from ten residents. The City Clerk on August 16 entered an Order <br />Fixing Ballot Title. The proposed initiated measure is to transfer the existing <br />urban renewal authority from the Louisville Revitalization Commission to the <br />Louisville City Council. Pursuant to C.R.S. §31-25-115(1), such a transfer of an <br />existing authority to the governing body may be accomplished only by majority <br />vote at a regular election. Resolution No. 41, Series 2007 submits to the voters <br />the ballot question of whether to adopt the initiated measure. After City Council <br />action on this resolution, the ordinance is required to be published and the ballot <br />title would then be referred to the Office of the Boulder County Clerk and <br />Recorder, which office is conducting the November 6, 2007 election as a <br />coordinated mail ballot election. Staff recommended Council submit the Initiated <br />Ordinance to the voters at the November 6, 2007 Election, by adopting a motion <br />approving Resolution No. 41, Series, 2007. <br />COUNCIL COMMENT <br />Mayor Pro Tem Brown asked what process was followed to set the ballot title. <br />City Clerk Varra explained a public hearing was conducted on August 13 and <br />testimony was given. Pursuant to the State Statues regarding ballot titles and <br />the testimony given at the hearing, the ballot title was set. <br />City Attorney Light explained i:he City Clerk consulted with his office relative to <br />the ballot title. Two versions, a long and short version of the ballot title were <br />made available at the hearing. According to State Statutes, the ballot title must <br />give a fair and accurate summary. After receiving testimony, and referring to the <br />State Statute, the City Clerk set the ballot title. <br />MOTION: Mayor Pro Tem Brown moved to approve Resolution No. 42, Series <br />2007, with the amendment to delete the phrase "an elected body." <br />
