Louisville City Council Meeting <br />August 21,2001 <br />Page 5 <br /> <br />· Article 7-2. Referendum (c). Referendum Petition requiring 2.5 percent of the <br /> registered electors. Howard asked if the statute currently provides for 10 percent <br /> of the registered electors. Light stated that it is currently 5 percent. <br />· Article 7-3 Referendum (a). Initiative or Referendum Petition deemed insufficient <br /> may be amended within 15 days. Light confirmed that there is a 15-day cure <br /> period. <br />· Article 7-5 Order of the Ballot (b). An initiated ordinance or a referred ordinance <br /> shall have priority on the ballot over any ordinance submitted by the Council. <br /> Light confirmed that a citizen initiative ordinance would have a higher priority on <br /> the ballot. <br />· Article 7-5 Initiated Ordinance (a). Initiated ordinance adopted by the registered <br /> electors may not be amended or repealed for a period of (4) years after the date of <br /> the election on the initiated ordinance, unless the amendment or repeal is <br /> approved by the registered electors. Howard asked if two City Councils would be <br /> affected by an initiated ordinance. Light confirmed Howard's statement was <br /> correct. <br />· Article 7-5 Referred Ordinance (b). The Council may not readopt a referred <br /> ordinance repealed by the registered electors for a period of four years. Howard <br /> stated that it would take two seated Councils before the issue could be brought up <br /> again. Light confirmed Howard's statement was correct, unless earlier referred to <br /> a vote. <br />· Article 7-8 Withdrawal/Reinstatement of Initiative/Referendum or Recall Petition <br /> <br /> (a). Provides withdrawal within forty-five days prior to an election. Howard <br /> asked if this that is what is currently done. Light stated that this is a mechanism <br /> to withdraw an initiative petition. Light explained that there is a provision in the <br /> statutes for statewide initiatives to be withdrawn. <br />· Article 10 - Board and Commissions. Howard stated that the article basically <br /> states that boards and commissions are untouchable, and even if there is no need <br /> for a board, the City must still maintain the board. <br />· Article 12-4 Lease Purchases. Howard asked if this referred to Tabor matters. <br /> Light stated that there is an existing ordinance that prohibits lease purchases. <br />· Article 13-2 Utility Rates and Finances. Howard voiced concern over the lack of <br /> provisions for programs such as the senior property tax and water rebates. Light <br /> stated that he would review that matter, but believed they would be preserved by <br /> the saving clause, which allow the existing ordinances to continue. <br />· Article 17- Transitional Provisions. He voiced concern for the contractual <br /> relations transition. Light stated that the savings clause is intended to save the <br /> City's ability to pursue claims that arise under ordinances that may be repealed, <br /> altered or revised by the Charter. <br /> <br />Sisk commented that many of Councilman Howard's questions would be part of the <br />issues addressed during the Home Rule Charter process.
