RESOLUTION NO. 79 <br /> SERIES 2012 <br /> A RESOLUTION APPROVING OF A FINAL SUBDIVISION PLAT FOR THE ST. <br /> LOUIS PARISH AND COMMERCIAL PARK SUBDIVISION AND FINAL PLANNED <br /> UNIT DEVELOPMENT (PUD) FOR THE ROCKY MOUNTAIN TENNIS CENTER. <br /> WHEREAS, there has been submitted to the Louisville City Council an <br /> application for approval of a Final Subdivision Plat for the St Louis and Commercial <br /> Park Subdivision and Final Planned Unit Development (PUD) for the Rocky Mountain <br /> Tennis Center; and <br /> WHEREAS, the City Staff has reviewed the information submitted and found it to <br /> comply with the St. Louis Parrish and Commercial Park General Development Plan <br /> (GDP) and the Louisville Municipal Code Sec. 16.12.030 and Sec. 17.28.170; and <br /> WHEREAS, after a duly noticed public hearing on May 10, 2012, where <br /> evidence and testimony were entered into the record, including the findings in the <br /> Louisville Planning Commission Staff Report dated May 10, 2012, the Planning <br /> Commission recommended approval of said Final Subdivision Plat and Final PUD Plan <br /> with the following condition: <br /> 1. The plan sheets shall be updated prior to City Council review to indicate 20 spaces of <br /> the 69 space southern parking lot shown in Phase 18 (page 17 of 24), shall be moved to <br /> Phase 1A. <br /> 2. Final approval of the proposed public land dedication and payment-in-lieu of a dedication <br /> is subject to a current appraisal and will be determined prior to City Council review. <br /> 3. Staff requests the cash in lieu figure be finalized prior to review by City Council. <br /> 4. The applicant shall continue to work with Public Works on finalizing details from the April <br /> 30, 2012 applicant comment letter. These items should be finalized prior to recordation <br /> of Subdivision Agreement. <br /> WHEREAS, City Council has reviewed the application, including the <br /> recommendation of the Planning Commission, and finds that it complies with Chapter <br /> 17.40.100 of the Louisville Municipal Code; <br /> NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br /> Louisville, Colorado does hereby approve a Final Subdivision Plat for the St Louis and <br /> Commercial Park Subdivision and Final Planned Unit Development (PUD) for the Rocky <br /> Mountain Tennis Center, with one condition: <br /> 1. `Outdoor tennis court night lighting shall be used only during the hours of 7 a.m. and 11 <br /> p.m. This condition does not apply to safety, landscaping or security lighting." <br />
