<br />RESOLUTION NO.2 <br />SERIES 1994 <br /> <br />A RESOLUTION APPROVING A FINAL SUBDIVISION PLAT <br />AND A FINAL PUD DEVEWPMENT PLAN FOR BRIDGEFIELD EAST <br /> <br />WHEREAS, there has been submitted to the Louisville City Council by WHP, Ltd, <br />represented by Jim Leach, a request for approval of a Final Subdivision Plat and a Final PUD <br />Development Plan for Bridgefield East Subdivision; and <br /> <br />WHEREAS, all materials related to the Final Subdivision Plat and Final PUD <br />Development Plan have been reviewed by city staff and the Planning Commission and found to <br />be in compliance with the Louisville zoning ordinances, subdivision regulations; and <br /> <br />WHEREAS, after a properly advertised public hearing concerning said Final Subdivision <br />Plat and Final PUD Development Plan, the Planning Commission recommended to the City <br />Council approval with the following conditions: <br /> <br />1. The Public Words Director and the developer work out those things <br />that allow for easier access for snow removal, maintaining the <br />street at its width; <br /> <br />2. The City Attorney to review the ditch issue and find, in her <br />opinion, that there is no significant risk of negligence by the City <br />of Louisville,' <br /> <br />3. That Resolution No. 36, Series 1993, as it applies to residential <br />growth limitations, clearly applies; <br /> <br />4. That the City Attorney review the Homeowner's Association <br />documentation to ensure that the maintenance of the ditch and the <br />small park is included in language such that the City can be <br />assured it would happen in the future; <br /> <br />5. That there is a written agreement, which is to be approved by the <br />City Attorney, between the ditch owner and the City regarding the <br />maintenance of the ditch; <br /> <br />6. Final street design must be accepted by the Fire District; <br /> <br />7. Remaining 12,307 s.f public land dedication shall be met by cash <br />in lieu of payment prior to recording the final plat; <br /> <br />8. Street name of cul-de-sac shall be shown on final plat,' <br /> <br />9. Dedication language shall be approved by the City Attorney; <br /> <br />10. Front setback of Lot 2 shall be 25' from property line. <br />
