<br />Louisville Local Licensing Authority <br />Meeting Date: February 28, 2005 <br />Page 4 of 7 <br /> <br />AUTHORITY ATTORNEY'S REPORT <br /> <br />Wilson asked about the training the Authority members will be required to take due to <br />the new charter amendment. Attorney Light reported training will be offered twice a <br />year and each member will have to attend once every two years. No dates have been <br />set yet. <br /> <br />Koertje asked about the availability of the Rules of Procedures and Bylaws. Attorney <br />Light stated they could easily be made available in electronic form. <br /> <br />AUTHORITY BUSINESS - CONTINUED <br /> <br />E. Show Cause Hearings/Renewal Hearing - Celtic Way, L TD d/b/a Druids <br />Arms - Tavern License - 809 Main Street <br /> <br />Mulvahill opened the renewal hearing for Druids Arms. <br /> <br />Mark Shapiro, special prosecutor for the Local Licensing Authority entered his name for <br />the record. He stated the attorney for Druids Arms, Michael Rennich, had informed him <br />there would be no one present for the licensee for this hearing. Mulvahill noted there <br />was no one present for the licensee, either themselves or by attorney representation. <br /> <br />Attorney Light asked Secretary Hanson about the history of the application for renewal. <br />He asked if the premises had been posted concerning the hearing. Hanson responded <br />they had not as the premises closed before the ten day time period and there was not <br />access. Light asked if the applicant was served notice of the hearing. The answer was <br />yes. Attorney Light reported the renewal fees have not been paid and asked Secretary <br />Hanson to provide background. Hanson reported the license had expired on 9/22/04, a <br />late renewal was submitted on 11/22/04 and on 2/14/05 she received an email from Mr. <br />Shapiro stating he had heard from Mr. Rennich and Druids Arms had decided to close <br />their doors on 2/12/05. Hanson stated Mr. Rennich came to her office and confirmed <br />the establishment closed. Mr. Charnley also visited Hanson and reported with the <br />combination of high rent and a possible suspension, Druids had decided to close their <br />doors. The checks for the renewal were given back to Mr. Charnley and he stated the <br />bank account was closed. <br /> <br />Attorney Light reported state liquor code states renewal can be denied for good cause <br />which includes non-payment of annual renewal fees. Attorney Light reviewed the <br />options available the Authority. Discussion centered on proceeding with the show <br />cause hearings or pursuing the non-payment of fees issue. Mr. Shapiro commented <br />after the last hearing, the Authority made it clear they wanted him to pursue both the <br />show cause issues and the renewal issue.
