Louisville City Council Meeting <br />December 4, 2001 <br />Page 17 <br /> <br />City Attorney offered a friendly amendment to the motion to revise condition number//4 <br />as follows: "The subdivision agreements shall include a provision establishing a public <br />use fee in-lieu of land dedication in an amount equal to 12% of the current fair percent <br />value of property as established by a certified appraisal prepared at the applicant's <br />expense in which is acceptable to the City. Said fees shall be paid by prior to the <br />issuance of building permits of the property." Light added the phrase "subject to the <br />foregoing conditions," to the Now, Therefore clause. <br /> <br />Mayer and Sisk accepted the friendly amendment. <br /> <br />Pedersen asked if the McCaslin Interchange Fee could be conditioned for payment upon <br />the certificate of occupancy. <br /> <br />Sisk offered a friendly amendment to add condition number #5 that the McCaslin <br />Interchange Fee would be paid prior to the first certificate of occupancy, or no later <br />September 1, 2002. <br /> <br />Mayer accepted the amendment. <br /> <br />Light offered a friendly amendment to condition number #5, "that the McCaslin <br />Interchange Fee, payable at the rate of $10,465.51 per acre, be paid in full." <br /> <br />Mayer and Sisk accepted the amendment. <br /> <br />Mayer offered a friendly amendment that the acreage be specified as gross acreage. <br /> <br />Keany asked if Councilman Mayer wanted a condition that would move the bike racks at <br />Walgreen' s. <br /> <br />Mayer offered a friendly amendment to add condition number #6, that the bike racks be <br />moved to the front of the building and the exact location to be resolved between Staff and <br />the applicant. <br /> <br />Sisk accepted the amendment. <br /> <br />Planning Director Wood clarified that the cover sheet of the PUD, does show an auto <br />retail service area of 13,000. He stated that he would like to work with the applicant to <br />separate the auto service from the auto retail. He asked for a condition that the auto <br />service use not to exceed 3,700 SF. <br /> <br />Davidson offered a friendly amendment to add a condition that the auto service use not to <br />exceed 3,700 SF. <br /> <br />Mayer and Sisk accepted the amendment. <br /> <br />17 <br /> <br /> <br />
