<br />would reasonably believe that the animal would <br />cause physical injury to that person; or <br /> <br />4. Any animal found to be vicious under the <br />provisions of Section 6.12.020.E. <br /> <br />M. Animal control officer. The code enforcement officer <br />appointed pursuant to Section 6.12.080 of this Chapter. <br /> <br />Section 2. Section 6.12.020 of the Louisville Municipal <br />Code is hereby repealed and reenacted, with amendments, to read as <br />follows: <br /> <br />Section 6.12.020 <br /> <br />vicious Animals <br /> <br />A. It shall be unlawful for any person to own, keep, harbor <br />or possess any vicious animal anywhere in the City, <br />except as permitted by this section, or to permit a <br />vicious animal to run at large within the city. <br /> <br />B. Defenses. It shall be an affirmative defense to charges <br />under subsection A. if: <br /> <br />1. The animal was acting in self defense, acting <br />in defense of its offspring, or acting in <br />defense of its kennelmates; <br /> <br />2. The person attacked, injured, bitten or in <br />fear of injury was committing, attempting or <br />threatening to commit a crime; <br /> <br />3. The person attacked, injured, bitten or in <br />fear of lnjury was at the time teasing, <br />tormenting, abusing, or assaulting the animal <br />in a manner reasonably calculated to provoke <br />the animal to attack or bite; <br /> <br />4. The person attacked, injured, bitten or in <br />fear of injury was attempting to aid the <br />animal when it was injured; or <br /> <br />5. The person attacked, injured, bitten or in <br />fear of injury was attempting to capture the <br />animal in the absence of the owner or keeper. <br /> <br />C. Impoundment of a vicious animal. The ani mal <br />control officer and any police officer has the <br />authority to impound any animal subject to <br />subsection A. of this section. <br /> <br />2 <br />
