City Council Meeting Minutes July 19, 2005 Page 3 of 9 LOUSIVLLE SOUTH 96T" STREET ANNEXATION NO. 3, AND SETTING A PUBLIC HEARING THEREON -SET PUBLIC HEARING FOR 9/6/05 Mayor Sisk requested a Staff presentation. Planning Director Paul Wood explained the City initiated this annexation by petition to annex a 1.4-acre parcel in conjunction with a road construction project at the southeast corner of S. 96th Street and Dillon Road. Land was acquired from the Schreiter property for' road right-of-way purposes in 2003. Resolution No. 27, Series 2005 supersedes Resolution No. 26 and is intended to establish a hearing date within the timeframe required by state statute. Resolution No. 26, 2005 was approved by Council on July 5, 2005, and is being repealed as it established a timeframe for the public hearing, which exceeds the maximum 60- daytimeframe between the effective date of the resolution of substantial compliance and the public hearing. Mayor Sisk requested public c:omment. There were no comments. Mayor Sisk asked for City Attc,rney recommendation. City Attorney Light advised Council that only one motion vvas required. MOTION: Council member V:an Pelt moved to repeal Resolution No. 26, 2005, and approve Resolution No. 27, 2005, and set a public hearing for September 6, 2005, seconded by Council member Levihn. All in favor. Absent: Council members Keany, Marsella and Brown. ORDINANCE No. 145Ei, SERIES 2004 - AN ORDINANCE ZONING PROPERTY KNOWN AS 1fHE HOYLE PROPERTY - 2"d reading -public hearing (advertised Dairy Camera 9/25/04 & 2/27/05) -continued from 10/19/04, 2/1/05, 3/17/05, & 5/17/05 -Applicant requests a continuance Mayor Sisk requested a City Attorney introduction. City Attorney Light read Ordinance No. 1456, Series 2004. Mayor Sisk requested a Staff presentation. Planning Director Paul Wood reported on correspondence received from Mr. Richard Lopez, representing i:he Hoyle family, requesting a delay in the hearing until such time as the City has acted on the pending Comprehensive Plan Update. MOTION: Mayor Sisk moved to continue the public hearing to October 4, 2005, seconded by Council member Clabots. All in favor. Absent: Council members Keany, Marsella and Brown.
