RESOLUTION N0.40 <br />SERIES 2007 <br />A RESOLUTION APPROVING A FINAL SUBDIVISION PLAT AND FINAL PLANNED <br />UNIT DEVELOPMENT (PUD) PLAN FOR 1900 CHERRY STREET, LOTS 1 - 2, <br />BLOCK 1, COLORADO TECHNOLOGY CENTER FILING N0.3. <br />WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a final subdivision plat and final planned unit development (PUD) plan to construct a <br />flex building with proposed uses of office, light manufacturing and warehousing with multiple <br />tenants at 1900 Cherry Street, Lots 1 and 2, Block 1, Colorado Technology Center Filing No. 3; <br />and <br />WHEREAS, all materials related to the final subdivision plat and final PUD <br />development plan have been reviewed by City Staff and the Planning Commission and found, <br />to be in compliance with the Louisville zoning ordinances, subdivision regulations, the <br />Industrial Development Design Star.~dards and Guidelines, related policies and previous <br />approvals; and <br />WHEREAS, after a duly noticed public hearing concerning said final subdivision plat <br />and final PUD development plan on. July 12, 2007, where evidence and testimony were entered <br />into the public record, including the; staff report dated July 12, 2007, the Planning Commission <br />recommended approval to the City Council, with the following three conditions <br />1. The applicant shall execute a Subdivision Agreement to ensure the development of <br />required public improvements. <br />2. The applicant shall meet the :required public use dedication by the payment of a cash-in- <br />lieupayment equivalent to l:?% of the appraised value of the land at the time of <br />subdivision. Such payment shall be made prior to the issuance of a building permit. <br />3. The applicant shall provide either a fence or hedge on top of any retaining wall over 30" <br />in height for public safety purposes; and <br />WHEREAS, City Council has reviewed the application, including the recommendation <br />of the Planning Commission and that the application should be approved, with the following <br />conditions: <br />1.
