INTERGOVERNMENTAL AGREEMENT BY AND BETWEEN THE CITY OF <br />LOUISVILLE AND THE BOULDER COUNTY CLERK AND RECORDER FOR THE <br />CONDUCT ANDADMINISTRATION OF THE 2007 COORDINATED ELECTION <br />TO BE HELD NOVEMBER 6, 2007 <br />PARTIES. <br />1.0 The parties to this Intergovernmental Agreement (IGA) are the City of Louisville, <br />a Colorado home-rule municipality (the "City"), and the County Clerk and Recorder for the <br />County of Boulder, Colorado (the "County Clerk"). <br />RECITALS AND PURPOSES. <br />2.1 Pursuant to section 18(2)(a) of Article XIV of the Colorado Constitution and <br />section 29-1-203, C.R.S., the County Clerk and the City may cooperate or contract with each <br />other to provide any function, service or facility lawfully authorized to each, and any such <br />contract may provide for the sharing of costs, the imposition of taxes, and incurring of debt. <br />2.2 The County Clerk and the City are authorized to conduct elections as provided by <br />law. <br />2.3 The General Election, to be held November 6, 2007 (Election), shall be conducted <br />as a "Coordinated Election" as defined in the Uniform Election Code of 1992 (the Code) and the <br />Rules and Regulations of the Colorado Secretary of State (the Rules). <br />2.4 The County Clerk and the City have determined that it is in the best interests of <br />the City, and its inhabitants, to cooperate and conduct the Election upon the terms and conditions <br />contained herein. <br />2.5 The purpose of this IGA is to set forth the tasks to be completed by the County <br />Clerk and the City to conduct and finance the Election. <br />2.6 The County Clerk and the jurisdictions agree that it is in every entities best <br />interest to conduct this election as a mail ballot election as allowed by Colorado Statute and <br />pursuant to the Colorado Revised Statutes and Secretary of State Rules. <br />2.7 Section 20 of Article X of the Colorado Constitution (TABOR Amendment) <br />requires the production of a mailed notice (TABOR Notice) concerning certain ballot issues that <br />will be submitted to the electors of Boulder County. <br />2.8 The TABOR Notices of several jurisdictions are to be sent as a package where <br />jurisdictions overlap (TABOR Notice Package). <br />
