WHEREAS, the remaining members of the LRC are six Louisville citizens that are <br />appointed by the Louisville City Council on staggered terms, two of which expire every two <br />years; and <br />WHEREAS, all Louisville citizens are eligible to apply for and be appointed to any <br />regularly occurring or other vacancy on the LRC; and <br />WHEREAS, pursuant to the urban renewal plan and the Cooperation Agreement, the <br />City Council retains all land use planning authority over any potential project that may come <br />forward in the urban renewal area; a~zd <br />WHEREAS, there is no termination clause in the Cooperation Agreement that allows <br />either party to unilaterally terminate the Agreement and, accordingly, neither the City of <br />Louisville nor the LRC may terminate, repudiate or otherwise fail to comply with the terms of <br />the Cooperation Agreement without liability; and <br />WHEREAS, the Louisville City Council must approve the LRC budget annually before <br />the LRC may make any expenditure:;; and <br />WHEREAS, the Louisville City Council has determined that it is in the best interest of <br />the citizens of the City of Louisville to have the LRC as the body of Louisville residents to <br />evaluate and review urban renewal projects in the urban renewal area, pursuant to the <br />aforementioned resolutions; and <br />WHEREAS, an initiative ("' Initiative 2A") has been put forward that would alter this <br />framework that has been established by the City Council for evaluating and executing urban <br />renewal projects for the urban renewal area; and <br />WHEREAS, the City Council has determined that 2A may potentially mislead the <br />Citizens of Louisville by implying that the City Council has relinquished planning, financial and <br />other control over potential developnnent in the urban renewal area; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />The City Council of the City of Louisville does hereby declare that it does not support Initiative <br />2A. <br />PASSED AND ADOPTED this 2nd day of October , 2007. <br />Charles S' ay , <br />2 <br />
