INTERGOVERNMENTAL AGREEMENT <br />This Intergovernmental Agreement (` ~~greement") is between the City of Lafayette, a Colorado <br />home rule municipality ("Lafayette"), and the City of Louisville, a Colorado home rule <br />municipality ("Louisville"), collectively the "Parties", and is made to be effective as of the <br />a~ day of (lwen,,~ , 2007. <br />RECITALS <br />1. A section of Hecla Drive east of Highway 42 is proposed to be constructed by <br />Louisville or a Louisville developer from its current terminus within Louisville north to Paschal <br />Drive which is located in Lafayette. <br />2. The Parties anticipate the need for a traffic signal at the intersection of Paschal <br />Drive and Highway 42 and the need to extend Paschal Drive to the west of Highway 42 to serve <br />properties located in Louisville and Lafayette. <br />3. The Parties desire to align Paschal Drive west of Highway 42 to match the <br />alignment of Paschal Drive east of Highway 42, which alignment requires that the right-of--way <br />for the westerly extension of Paschal Drive be generally centered on the Parties' shared <br />boundary. <br />4. The Parties desire to enter into an IGA to confirm anticipated street alignments <br />and establish responsibilities for the Hecla Drive connection to existing Paschal Drive, the <br />installation of a traffic signal improvements at the Paschal Drive/Highway 42 intersection, the <br />right-of--way acquisition for and construction and maintenance of a westerly extension of Paschal <br />Drive, and related matters. <br />5. The Parties are authorized to enter into this Agreement pursuant to their <br />respective charters and state law, including but not limited to C.R.S. § 29-1-203. <br />AGREEMENT <br />In consideration of the terms and provisions herein, the Parties agree as follows: <br />1. Paschal/Highway 42 Traffic Si ng al Improvements. <br />a. Lafayette or Louisville may initiate installation of Pascal Drive/Highway <br />42 intersection traffic signal improvements when signal warrants are met, CDOT <br />approval is obtained, and funding is available as set forth herein. Louisville and <br />Lafayette shall each be responsible for one-half of the costs of the traffic signal <br />improvements, and the traffic signal improvements, when completed, shall be owned by <br />CDOT. The foregoing cost-sharing provision shall not apply to roadway pavement, road <br />base, sub-grade preparation, curb and gutter, street drainage and other street <br />improvements that are necessary for proper configuration and installation of the traffic <br />1 <br />
