e. Louisville and Lafayette shall each provide any right-of--way it owns that <br />is required for the traffic signal improvements. Each Party shall be responsible to obtain <br />from properties within its respective jurisdiction any other right of way required for the <br />traffic signal improvements. Such acquisitions shall be by dedication or otherwise at the <br />expense of the City having jurisdiction. Ifright-of--way located outside of the jurisdiction <br />of Lafayette and Louisville is required for the improvements, the lead agency may <br />acquire such right-of--way. In such case, the other Party shall repay the lead agency for <br />half of the costs of the land so acquired, which repayment shall be made in the same <br />manner as provided in sub-paragraph b. above. The Parties shall work diligently and in <br />good faith to obtain all right-of--way necessary for the intersection improvements within <br />one year of the date of this Agreement. Nothing in this Agreement requires the use of <br />eminent domain by either Party, nor shall this Agreement require either party to <br />appropriate funds for such acquisition. <br />f. This Agreement is not intended and shall not be construed to affect either <br />Party's ability to obtain cost recovery payments for traffic signal improvements from <br />developments within their respective jurisdictions. <br />2. Paschal Drive Extensiorv'West of Highway 42. <br />a. The Parties agree that the alignment and configuration for the Paschal <br />Drive extension west of Highway 42 shall be as set forth on Exhibit A attached hereto <br />and incorporated herein by reference (the "Paschal West Extension"), unless the Parties <br />otherwise agree in writing. The right-of--way width for the Paschal West Extension shall <br />be not less than 80 feet and the cross-section for construction of such Extension shall be <br />as set forth on Exhibit A. The Parties agree that access points along the Paschal West <br />Extension shall be limited to those shown on Exhibit A. <br />b. Each Party shall be responsible to obtain the necessary right-of--way for <br />the Paschal West Extension within its respective jurisdiction. Such acquisitions shall be <br />by dedication or otherwise at the expense of the City having jurisdiction. <br />c. The Parties shall work diligently and in good faith to obtain all right-of- <br />way necessary for the Paschal West Extension within one year of the date of this <br />Agreement. Nothing in this Agreement requires the use of eminent domain by either <br />Party, nor shall this Agreement require either party to appropriate funds for such <br />acquisition. Other than right-of--way required to be provided to CDOT, any right-of--way <br />located within the municipal limits of Louisville shall be owned by Louisville, and any <br />right-of--way within the municipal limits of Lafayette shall be owned by Lafayette. The <br />Parties shall make such conveyances as are necessary to effectuate such division of right- <br />of-way ownership. <br />d. The Paschal West Extension improvements shall be constructed in <br />conformance with cross-section attached as Exhibit A, and in conformance with design <br />and construction standards to be mutually agreed upon by the Parties prior to bidding and <br />3 <br />
